PUBLIC COMMENTS <br /> <br />Public Comments are limited to 3 minutes per speaker, subject to adjustment by the Mayor. <br />When you address the City Council, you should fill out a speaker card and submit it to the <br />City Clerk so the order of speakers may be determined and an official record of names and <br />addresses obtained. The public is invited to make comments on items of public interest NOT <br />listed on the Agenda. <br /> <br />Dan Henriques, San Leandro resident, addressed the City Council regarding the issues he <br />has encountered with the San Leandro FedEx Kinko's and stated his belief that its staff <br />discriminated against him and committed a hate crime. <br /> <br />Martin Francis, San Leandro resident, addressed the City Council, extending an invitation <br />to the annual Flag Day celebration. He provided copies of the invitation to the Council. <br /> <br />Harold Perez, San Leandro resident, addressed the City Council regarding issues with his <br />neighbor involving a garbage-filled trailer, electricity theft and an illegally-constructed <br />fireplace. Mr. Perez expressed concern with parking issues and emissions from MV <br />Transportation's diesel vehicles. <br /> <br />6. CITY MANAGER AND CITY ATTORNEY REPORTS AND COMMENTS <br /> <br />City Manager J ermanis stated that he had no report. <br /> <br />City Attorney Jayne Williams informed the Council of an Assembly bill which will be heard <br />by the Assembly Local Government Committee on Wednesday, May 4. Ms. Williams noted <br />that this item came to her attention after the publication and posting of the Council's meeting <br />agenda. She indicated that the Council may want to consider taking a position on AB 194. <br />She provided the Council with a draft letter in opposition to the bill as well as a copy of the <br />proposed legislation. Ms. Williams asked for the Council's approval to discuss the item and <br />determine whether a letter in opposition to the bill should be sent by the Mayor. <br /> <br />Ms. Williams stated that the proposed legislation would amend the Brown Act to shift the <br />burden of proof to local governments for Brown Act litigation and would require a city to <br />prove in court by clear and convincing evidence that it did not violate the Brown Act. <br /> <br />Minute Order No. 2005-019, Motion Adding to the Agenda the Consideration of a Letter in <br />Opposition to AB 194 (Dymally). (1123) <br /> <br />By an unanimous vote, the City Council added to the agenda the consideration of a <br />letter in opposition to AB 194 (Dymally). It was the consensus of the City Council to <br />authorize Mayor Young to submit a letter in opposition to AB 194. <br />
