PUBLIC HEARINGS <br /> <br />Public Hearing Comments are limited to 5 minutes per speaker, subject to adjustment by the <br />Mayor. When you address the City Council, you should fill out a speaker card and submit it <br />to the City Clerk so the order of speakers may be determined and an official record of names <br />and addresses obtained. <br /> <br />A. Matter ofhnposing Liens for Non-Payment of Delinquent 2004-05 Sewer Service and <br />Weed Abatement Charges, and 2005 Business License Fees (permits the City to place <br />delinquent charges on the applicable fiscal year 2005-06 Alameda County secured <br />property tax roll). <br /> <br />This being the time and place for the Public Hearing on the above matter, City Manager <br />Jermanis gave an overview of the item and introduced Assistant to the City Manager <br />Cynthia Battenberg. Ms. Battenberg provided additional information on the list of <br />properties proposed for lien. <br /> <br />The Hearing was then opened to the public. <br /> <br />Steve Shepherd, property owner of 630 Williams St., addressed the City Council, <br />commenting that he rents the property to a business, and stating that he feels it is unfair <br />that the delinquent fees will be passed through to him as the property owner. <br /> <br />Lou Filipovich, 15376 Laverne Drive, addressed the City Council, agreeing with the <br />previous speaker and commenting that he feels the meeting proceedings are being <br />rushed. <br /> <br />There being no further comments from the public, and without objection, the Public <br />Hearing was closed. <br /> <br />Councilmember Nardine asked whether the business or the property owner would be <br />liable if a business within the West San Leandro Business hnprovement District failed <br />to pay its fee. City Manager J ermanis indicated that he would ask the City Attorney to <br />research the question and report back to the Council. <br /> <br />Councilmember Santos commented on property owners that he believes have not been <br />given adequate notice that their properties are subject to lien. <br /> <br /> <br />Mr. J ermanis indicated that City staff will work with property owners to determine <br />whether the liens have been levied properly. <br /> <br />Some members of the Council expressed interest in reviewing the current process of <br />imposing liens on property owners for non-payment of fees and expressing concern <br />regarding the fairness of this practice. Mr. Jermanis noted that the process is not new, <br />and property owners are made aware that there is a problem well before they receive the <br />public hearing notice regarding the lien. <br />
