<br />MINUTES Page 8 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-October 17, 2005 <br /> <br />Lou Filipovich, San Leandro resident, addressed the City Council regarding the meeting of <br />October 3, 2005 and the lack of news coverage regarding the LINKS Shuttle. He commented <br />regarding the board and commission appointment process and the ability of members of the <br />public to raise a point of order. <br /> <br />(Following Public Comments, the City Council continued its discussion on Public <br />Hearing Item 3.B.) <br /> <br />6. CITY MANAGER AND CITY ATTORNEY REPORTS AND COMMENTS <br /> <br />City Manager Jermanis responded to Mr. Hemiques' comments. He commented that the <br />Police Department has investigated Mr. Henriques' allegations, found no evidence of a hate <br />crime on the part of Kinkos, and does not intend to pursue the matter further. Mr. Jermanis <br />stated that the Police Department supports Mr. Henriques' right to distribute his literature in a <br />public venue. <br /> <br />Mr. Jermanis commented that the subject of clean air is one in which the Council is very <br />interested and involved. Mr. Jermanis indicated that the City has worked with ACI to convert <br />its diesel trucks to clean air vehicles. He noted that he would share with staff the literature <br />provided by Ms. Aborashed and will work to identify ways to implement the ideas. Mr. <br />J ermanis expressed appreciation for the efforts being undertaken to promote clean air in the <br />community. <br /> <br />City Attorney Jayne Williams addressed some of the procedural issues raised by Mr. <br />Filipovich. Regarding the public's right to raise a point of order at a Council meeting, Ms. <br />Williams indicated that this is inappropriate. At a business meeting of the City Council, any <br />member of the City Council can call for a point of order through the Chair. The public can <br />raise issues under Public Comments, but cannot call for a point of order. She commented that <br />the press has no obligation to cover City Council proceedings. <br /> <br />7. AMENDMENT OF CONSENT CALENDAR <br /> <br />City Councilmembers or staff have an opportunity at this time to request that an item be <br />removed from the Consent Calendar for the presentation of a staff report or other special <br />consideration. Members of the Public may request the opportunity to address the City <br />Council regarding items remaining on the Consent Calendar by filling out a speaker card and <br />submitting it to the City Clerk prior to the calling of Item 7, Amendment of Consent <br />Calendar. Items remaining on the Consent Calendar will be considered for approval under <br />one motion. <br /> <br />Public Comments on the Consent Calendar Item 8.E.: <br /> <br />Lou Filipovich, San Leandro resident, addressed the City Council, expressing his <br />disagreement with the statements made by the City Attorney under Item 6 and commenting <br /> <br />
