<br />A. Affordable Rent means the rent levels specified in California Health and Safety <br />Code Section 50053 for rental Target Units reserved for Very Low or Lower <br />Income Households adjusted for household size as set forth in Section 6-3106. <br /> <br />B. Affordable Sales Price means a sales price resulting in a Housing Cost at which <br />Lower, Very Low, and Moderate Income Households can qualify for the purchase <br />of a Target Unit, calculated on the basis of underwriting standards of mortgage <br />financing available for the development as adjusted for household size under <br />Section 6-3106, and not to exceed the parameters set forth in California Health <br />and Safety Code Section 50052.5. <br /> <br />C. Approval Authority means a person or body that is authorized to approve the <br />Housing Development as specified in the San Leandro Zoning Code. <br /> <br />D. Concession or Incentive means such regulatory concessions as specified in <br />California Government Code Subsections 65915 (d) and (1) to include, but not be <br />limited to, a reduction of site development standards or modification of zoning <br />code requirements, direct financial incentives, approval of mixed-use zoning in <br />conjunction with the housing development, or any other regulatory incentive <br />which would result in identifiable cost avoidance or reductions. (See 6-3108 of <br />this Article.) <br /> <br />E. Density Bonus means: <br /> <br />1. A minimum density increase of at least 20 percent over the otherwise <br />Maximum Residential Density for development projects meeting the <br />criteria of Section 6-3104(A),(B), and (C), up to a maximum of35 percent <br />as set forth in Section 6-3104; <br /> <br />2. A minimum density increase of at least 5 percent over the otherwise <br />Maximum Residential Density for development projects meeting the <br />criteria of Section 6-31 04(D); and <br /> <br />3. The specific minimum density increase set forth in Section 6-3114 for a <br />project that qualifies for a Density Bonus due to establishment of a <br />qualifying child care facility, and the specific minimum density increase <br />set forth in Section 6-3116 for a project that qualifies for a Density Bonus <br />due to a qualifying land donation. <br /> <br />F. Density Bonus Condo Conversion means a density bonus provision under Section <br />65915.5 of the California Government Code. (See Article 24, Section 5-2418 of <br />the San Leandro Zoning Code.) <br /> <br />G. Density Bonus Housing Agreement means a legally binding agreement between a <br />developer and the City to ensure that the requirements of this Article are satisfied. <br />The agreement shall establish at least the following: the number of Target Units; <br /> <br />ORDINANCE NO. 2006-010 <br /> <br />2 <br />
