<br />DECLARATION OF LOCAL EMERGENCY <br />IN THE CITY OF SAN LEANDRO <br /> <br />WHEREAS, Government Code S 8630 authorizes the City Council to empower a <br />local official to proclaim the existence of a local emergency when the City Council is not <br />in session, provided that such proclamation is ratified by the City Council within seven <br />days; and <br /> <br />WHEREAS, the City Manager has been designated by the City Council as the <br />Director of Emergency Services by Section 3-4-124 of the San Leandro Municipal Code <br />and is thus empowered to declare a local emergency; and <br /> <br />WHEREAS, the 2005-2006 Winter Storms have caused major damage to the City <br />of San Leandro Shoreline Recreation Area due to heavy rains, floodwaters, high winds, <br />wave action and surge tides, and <br /> <br />WHEREAS, the series of storms has resulted in floodwaters topping the banks of <br />the shoreline levees, dumping hundreds oftons of debris on the Bay Trail, Marina <br />parking lots, parcourse dike, and marshlands. In addition, large areas of rip rap were <br />washed away or damaged during the storm, resulting in damage to the Bay Trail and <br />other shoreline access points, and causing the closure ofthe Bay Trail, and <br /> <br />WHEREAS, these impending conditions are likely to be beyond the control of the <br />services, personnel, equipment, facilities and resources of this City, and the combined <br />forces of other political subdivisions will be required to combat these dangers. <br /> <br />NOW THEREFORE, a local emergency is hereby declared on January 5, 2006, <br />within the City of San Leandro, and that the Governor is requested to proclaim a state of <br />emergency in the City of San Leandro, and that further he request a Presidential <br />Declaration. During this local emergency, the powers and duties of the City and Disaster <br />Council, as designated in Title 3, Section 4 of the San Leandro Municipal Code, shall be <br />as defined in federal, state and local law, including those laws that pertain to local <br />emergenCIes. <br /> <br />This Declaration shall be transmitted to the City Council within seven days for <br />ratification, and this local emergency shall continue until terminated by further <br />declaration of the undersigned, or by resolution of the City Council. <br /> <br />~.,.~ <br /> <br />January 5. 2006 <br />8:30 a.m. <br /> <br />
