o August 14, 2006 950 Lee Avenue San Leandro, CA 94577-2935 City of San Leandro City Attorney 835 East 14 Street San Leandro, CA 94577 Dear City Attorney Williams, The Garden Terrace Home Owners have reviewed the City Ordinances for Planning and zoning. We now feel that there have been violations of these ordinances and gross negligence on the part of the Planning Commisssion in passing the Langon proposed project for 1537 Hayes Street. The following are ordinences violated, in what we feel, is the order of importance. 3-28 "GoalS expresses the City's desire to continue to work with the HOAs to address land use and development issues". 'The key is to create as many avenues as possible for residents and other stake holders to become involved". David Langon did not call upon the Garden Terrace HOA to be involved in the early stages of the development. Only after the Commissioners meeting on 06/08/06 did he meet with a few Garden Terrace Home Owners. He later refused to make any compromise. We told him the houses needed to be rearranged to give a view we could live with, if we were going to give up our beautiful view of the San Leandro-Oakland hills. We also said our property values were at stake with Langon' s Present Plans. 2. 08 "PRIVACY AND VIEWS Encourage residential alterations, additions and new homes to be designed in a manner that respects the privacy of nearby homes and preselVes access to sunlight and views. Whereever feasable new or altered structures should avoid the disruption of panoramic or scenic views." No consideration, whatsoever, was shown regarding our loss of sunlight or views which the Langon project would take away. At the 06/22/06 meeting a Commissioner said we should move to Bay-O- Vista if we wanted nice views, as she did not have a nice view from her home bedroom window. (Evidently.. she is not familiar with the City Ordinances). 2.05 "ALTERATIONS, ADDITIONS, AND IN FILL Ensure that alterations, add- itions and infill development are compatable with existing homes and maintain aesthetically pleasing neighborhoods." On 06/0806 Planning Comission Chair Kleebauer stated the houses in David Langon proposals looked like '<tall posts with roofs on them." If this statement did not get into the minutes, there were plenty of witnesses who heard it. Why would Chair Kleebauer pass on the Langon proposal if she feels this way about how the houses looked. 2.06 "DENSITY TRANSITIONS Avoid abrupt transitions from high density to low density housing. Where high density development occurs, encourage such projects to step down in height and mass as they approach nearby low density areas."
