We now feel that there have been violations of these ordinances <br />and gross negligence on the part of the Planning Commisssion in passing the Langon <br />proposed project for 1537 Hayes Street. <br />The following are ordinences violated, in what we feel, is the order of importance. <br />3-28 "GoalS expresses the City's desire to continue to work with the HOAs to <br />address land use and development issues". 'The key is to create as many avenues as <br />possible for residents and other stake holders to become involved". <br />David Langon did not call upon the Garden Terrace HOA to be involved in the <br />early stages of the development. Only after the Commissioners meeting on 06/08/06 did <br />he meet with a few Garden Terrace Home Owners. He later refused to make any <br />compromise. We told him the houses needed to be rearranged to give a view we could <br />live with, if we were going to give up our beautiful view of the San Leandro-Oakland <br />hills. We also said our property values were at stake with Langon' s Present Plans. <br />2. 08 "PRIVACY AND VIEWS Encourage residential alterations, additions and new <br />homes to be designed in a manner that respects the privacy of nearby homes and <br />preselVes access to sunlight and views. Whereever feasable new or altered structures <br />should avoid the disruption of panoramic or scenic views." <br />No consideration, whatsoever, was shown regarding our loss of sunlight or views <br />which the Langon project would take away. <br />At the 06/22/06 meeting a Commissioner said we should move to Bay-O- Vista if <br />we wanted nice views, as she did not have a nice view from her home bedroom <br />window. (Evidently.. she is not familiar with the City Ordinances). <br />2.05 "ALTERATIONS, ADDITIONS, AND IN FILL Ensure that alterations, add- <br />itions and infill development are compatable with existing homes and maintain aesthetically <br />pleasing neighborhoods." <br />On 06/0806 Planning Comission Chair Kleebauer stated the houses in David <br />Langon proposals looked like '<tall posts with roofs on them." If this statement did not <br />get into the minutes, there were plenty of witnesses who heard it. Why would Chair <br />Kleebauer pass on the Langon proposal if she feels this way about how the houses <br />looked. <br />2.06 "DENSITY TRANSITIONS Avoid abrupt transitions from high density to <br />low density housing. Where high density development occurs, encourage such projects <br />to step down in height and mass as they approach nearby low density areas." <br />
