August 1, 2006

San Leandro City Clerk
835 E. 14th St
San Leandro, CA 94577

Dear Sir or Madam:

We are writing in support of an appeal in the decision regarding 2888 Darius Way that
was rendered by the planning board on Thursday July 20. After attending the meeting, we do
not feel that the concerns of the neighbors were taken into consideration fully.

Committee members admitted not having seen the property from the perspective of the
neighbors above and below; Furthermore, the architect made several comments about the
surrounding properties that made it clear he was also unaware (or unconcerned) about the
effect such a large building (or "compound" as he referred to it) would have on the
neighbors. Although this compound will not be within our view, we worry about the
precedent that it sets for the neighborhood. Although there are clearly not many lots of that
size here in Bay 0' Vista, there are several existing homeowners that could seek to build up
and cite this height exception as precedent set in their favor.

Another concern we have is that this is a single family residence neighborhood
Although the city has said a maximum of 10 adults can live in this home, the architect
admitted that the builder/owner would like to have closer to 20 family members living with
him. The number of residents will be difficult to enforce and will gready add to the noise
and tIaffic emanating from the property.

~
rian and Erin Head
Bay 0' Vista Homeowners
2898 Marineview Dr.
