San Leandro City Clerk
835 East 14th Street
San Leandro, CA 94577
August 2, 2006

Dear Sir or MadaIn,

We are writing to express our desire to appeal the Board of Zoning Adjustments' decision
to proceed with the project currently scheduled to be built at 2888 Darius Way.

,
We feel strongly that a compound of this size does not blend in with the current design of
homes in the Bay~O~ Vista area. At the BZA meeting, the architect indicated that the
owner plans to exceed the current restriction of 10 adults living in a single-family
dwelling and will attempt to get a variance to allow up to 20 adults to live there. Since
the area is not near to any public transportation, this could suggest that up to 20 cars may
need to be parked on the premises at any given time, not including visitors.

We feel that by allowing these structures to be built, a precedent will be set which will
allow more homes of this size to be built, or eXisting homes to be added-on, with no
regards to the current height restriction of 18 feet. Opinions regarding interference with
current neighbors' views were discussed among the Board, however, no one on the Board
visited existing homes prior to or after the meeting to actually see how the views were
affected.

Of particular concern to us is the integrity of the hill behind our home. As discussed at
the meeting, our swimming pool is about 10 feet from the edge of the hill. In 1964 when
the house was built,. the pool was about 20 yards from the edge of the bill. Upon
acquisition of the property at 2888 Darius in 1989, the contractor removed a huge
portion of the hill, leaving us feeling vulnerable to slides every winter. We are very
concerned that further digging into the hill will cause catastrophic slides.

We were extremely disappointed in the Board's approval of this property. For the above
reasons, we feel that this project should be put on hold until the above issues meet with
our approval.

Please infonn us. as to when the city council meeting discussing the appeal will be held.
Thank you.

Sincerely,

~~If~L
42l. /CAA--

Richard and Susan Sequeira
1777 Vistagrand Drive
San Leandro, CA 94577
