Monthly Remittance "Monthly Remittance" means the monthly payment made to the City by the Contractor as specified herein. Multi-Family Residence "Multi-Family Residence" means any building orstructure, or portion thereof used for residential purposes and having two (2) or more distinct living units. Owner "Owner" means the person holding the legal titre or having a right to possession to the real property to which Franchise Services are provided. Parties "Parties" means the City of San Leandro and the Contractor. Performance Review "Performance Review" means the review occurring every five years provided in Article 9.8. Public Containers "Public Containers" means containers designated and approved by the City for the collection of Solid Waste, Recyclable Materials, or Green Waste and located in public places and rights of way. Rates "Rates" means the service charges and Special Charges for Franchise Services billed by the Contractor from each Customer receiving service under this Franchise and set forth in the Schedule of Rates. Recycle, Recycling, Recycled "Recycle", "Recycling", and "Recycled" means all the activities necessary to the collection, processing and marketing of Recyclable Materials which would otherwise be disposed of in a landfill or incinerator in order to return them to the economy in the form of raw materials for new, reused, repaired, refabricated, remanufactured, or reconstituted products. The collection, transportation or Disposal of Solid Waste not intended far, or capable of, reuse is not Recycling. Recyclable Materials "Recyclable Materials" or "Recyclables" means discarded materials from Customers intended for and capable of being Recycled, and that are separated, set aside, handled, packaged or offered for collection by a Customer in a manner different from Solid Waste. Recyclables Processing Facility "Recyclables Processing Facility" means the facility(ies) used by the Contractor for processing and preparing collected Recyclable Materials for marketing, unless otherwise specified by the City which may, but is not required to specify. Recycling Revenues "Recycling Revenues" means all revenues resulting from the sale of Recyclable Materials collected through provision of Franchise Services. Refuse "Refuse" means waste material intended for Disposal and including: (1) all putrescible and nonputrescible wastes, whether in solid or liquid form, except liquid-carried industrial wastes or ~:~,xPa~,~~,~n~~~..~a ovouoo Page 6 of 59
