The failure of any person to receive a notice of violation that was sent via First Class U.S. Mail shall not affect the validity of any enforcement proceedings under this Chapter." Section 4. Section 1-12-41 O( c) is hereby amended to read as follows: "( c) Proof of service of the notice of violation shall be certified by a written declaration under penalty of petjury executed by the person effecting service, declaring the date, time, and manner that service was made, and the date and place of posting, if applicable. The declaration, along with the certificate of mailing, shall be affixed to a copy of the notice of violation and retained by the Enforcement Officer." Scction 5. Effective Date and Publication. This ordinance shall take effect thirty (30) days after adoption and the title thereof shall be published once prior to adoption. Section 6. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness ofthe remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it would have passed each section of the Ordinance irrespective of the fact that one or more of them would be declared unconstitutional or invalid. To this end, the provisions of the Ordinance are declared to be severable.
