<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2006-029 <br /> <br />(1481) <br /> <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />APPROVING AND AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN <br />THE CITY OF SAN LEANDRO AND THE ORO LOMA SANITARY DISTRICT <br />RELATED TO THE IMPLEMENTATION OF REFUSE, GREEN WASTE AND <br />RECYCLING SERVICES IN THE L3 AREA AND <br />RESCINDING RESOLUTION 2004-094 <br /> <br />WHEREAS, the City of San Leandro (City) and the Oro Lorna Sanitary District <br />(District) have entered into a "Term Sheet Agreement," as approved by the City on March <br />6,2006, and approved by the District on March 7, 2006, regarding implementation of refuse <br />and recycling services within the area of the City (commonly referred to as the "L3 area") as <br />provided by the District through its franchise agreement with Waste Management of <br />Alameda County (WMAC); and <br /> <br />WHEREAS, the provisions of the approved Term Sheet Agreement have been <br />incorporated into a final Agreement between the City and District (attached hereto) and the <br />City Council is familiar with the contents thereof; and <br /> <br />WHEREAS, Resolution 2004-094 passed by the City Council on June 21, 2004, <br />which gave the District notice of the City's intent to assert exclusive jurisdiction over the <br />District's refuse franchise in the L3 area is inconsistent with the purpose and intent of this <br />Agreement; and <br /> <br />WHEREAS, the District desires to continue to provide refuse and recycling services <br />in the L3 area; and <br /> <br />WHEREAS, the Agreement addresses the City's concerns about the recycling <br />program services in the L3 area and provides that the District will collect a fee that the City <br />intends to adopt to address the impact that the refuse, green waste and recycling services <br />have on municipal services. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE, <br />as follows: <br /> <br />1. That said agreement is hereby approved and execution thereof is hereby <br />authorized. <br /> <br />2. That Resolution 2004-094 is hereby repealed in its entirety. <br />
