<br />Urgency Ordinance Extension <br />Downtown Opportunity Sites <br /> <br />3 <br /> <br />November 6, 2006 <br /> <br />term development catalysts for on-gomg downtown revitalization and transit <br />usage. On August 1, 2005, the City Council adopted a moratorium (the "2005 <br />Moratorium") which prohibited the consideration and approval of certain land use <br />entitlements for all new retail establishments in excess of 10,000 square feet in the <br />City's Commercial Downtown zoning district. The purpose of the 2005 <br />Moratorium was to allow the City to study and consider the potential impact of <br />large retail sales development on the Commercial Downtown zone. The 2005 <br />Moratorium ended in November of 2005, with adoption of Zoning Code text <br />amendments related to the Commercial Downtown zoning district. Pursuant to <br />Government Code Section 65858(f), the City may adopt another ordinance which <br />covers the same property if the new ordinance is adopted to protect the public <br />health, safety and welfare from a different set of circumstances than those which <br />led to the adoption of the prior interim ordinance. The City may extend the <br />current Ordinance given that it was prompted by a different set of circumstances <br />than the 2005 Moratorium. Specifically, the current Ordinance was adopted to <br />allow the City to limit the development of 39 opportunity sites within the City <br />pending the outcome of the Strategy. The 2005 Moratorium, on the other hand, <br />was prompted by the City's desire to analyze the potential impact of retail sales <br />establishments in excess of 10,000 square feet on the Commercial Downtown <br />Zone. <br /> <br />Current City Council Policy <br />Not applicable <br /> <br />Previous City Council Action <br />Interim Urgency Ordinance (Ordinance 2006-017) was enacted by the City <br />Council at their October 2, 2006 meeting. <br /> <br />City Council Committee Review and Action <br />Not applicable <br /> <br />Applicable General Plan Policy <br />Not applicable <br /> <br />Permits and/or Variances Granted <br />Not applicable <br /> <br />Environmental Review <br />The extension of this interim ordinance is exempt from environmental review <br />under the California Environmental Quality Act pursuant to Public Resources <br />Code Section 21065. This is based on the finding that this Ordinance is not a <br />"project" within the meaning of Section 15378 of the State CEQA Guidelines, <br />because it has no potential for resulting in physical change in the environment, <br />
