Regulation of Professional Filming and Videotaping ~~2.4.1 00: PERMIT REQUIRED. All persons who engage in professional filming within the City of San Leandro shall be required to obtain a permit, except where the professional filming involved is for news gathering purposes. ~~2.4.200: APPLICATION. All persons seeking a permit for professional filming must submit an application to the Film Liaison on the forms provided by the City. ~~2.4.300: FEES. Unless exempt pursuant to Section 32.1.400, all persons shall pay a non- refundable application fee. The amount of this application fee shall be as set forth in San Leandro Administrative Code. All applicants granted a permit shall also pay a permit fee as set forth in the San Leandro Administrative Code prior to issuance of the permit. ~~2.4.400: FEE EXEMPTIONS. The following persons are exempt from the application fee requirement in Section 32.1.300: bona fide students, non-profit corporations, and persons engaging in public service filming. Notwithstanding this Section, all persons exempt from the application fee are required to obtain a permit and to pay any and all other required fees, rates or charges. &~2.4.500: WRITTEN PERMISSION REQUIRED. Prior to commencement of professional filming, all permitees are required to obtain and submit to the City evidence of written permission to enter the property from all property owners and tenants of those properties surrounding the location that will be directly affected by the professional filming. ~~2.4.600: WRITTEN NOTICE REQUIRED. Not less than seventy-two (72) hours prior to commencement of professional filming, all permitees shall provide written notice to all property owners or tenants within a 300-foot radius ofthe professional filming location. ~~2.4. 700: PROFESSIONAL FILMING HOURS. Professional filming shall not be permitted between the hours of 7:00 p.m. and 7:00 a.m. except as specifically allowed by the Film Liaison. ~~2.4.800: INSURANCE REQUIREMENTS. All permitees shall have insurance coverage of the type and in the amounts specified by the Film Liaison. Evidence of compliance must be submitted to the Film Liaison prior to professional filming. Each permittee shall hold harmless, defend and indemnify the City, its elected officials, officers, and employees from and against any or all loss, liability, expense, claim, costs (including costs of defense), suits and damages of every kind, nature and description from the negligence of the permittee or its agents.
