,3

August 3, 2007

San Leandro City Clerk
835 E. 14th Street
San Leandro, CA 94577

Dear Sir or Madam:

Weare appealing the decision by the City of San Leandro Board of Zoning Adjustments
regarding 2888 Darius Way (pLN2005.00063). Mr. Luong (applicant and property owner) had
requested approval of a Major View Preservation/Site Plan Review and Height Exception.

Staff reports describe the 'proposed project will be appropriate in scale to the surrounding
neighborhood and should have minimal impact on the surrounding neighbors' privacy. We
disagree. According to Metroscan, the average home in Bay.O- Vista is approximately 2400
square feet. The named project, excluding the pool house, is 12,005 square feet. The largest of
the new homes recently constructed on Darius Way is 5,000 square feet. lbis proposal would be
more than double the size of that home.

The project requests a height exception of 30 feet, which exceeds the 18 feet, or one story
maximum height as stated in Section 2-582.A of the City of San Leandro Zoning Code, Article
5. The project site is spacious enough to build a 2 story main house and construct a separate
garage building, inclusive of the proposed workshop that would minimally exceed the 18 feet
limit. If the project setback (west) is moved closer towards the front instead of the proposed 160
feet, the impact to the surrounding neighbors would be significantly minimized. The view of the
hillside across this area-is important to us. It is preferable than looking at the roof of a large
structure. Reducing the height would substantially reduce that impact. Landscaping will not
screen the view of the home from above.

Getting a view is not justification for a height variance and setting precedence for future projects.

Respectfully,

- ----~

)k'-~ " --.~.~" -- /'
- ~..
y ../ -::=::".....-...
Wayland Lew and Su~anian
1761 Vista Grand Drive

Bay-O-Vista neighbors in support of this letter:

Kenneth Costa
Z674 Darius Way

Edith Eschen
2881 Marineview

Sandra Dyer
2726 Darius Way

Frances Gould
1749 Vista Grand Drive
