<br />CITY OF SAN LEANDRO <br /> <br />STAFF REPORT <br /> <br />APPROVED AND <br />FORWARDED <br />TO CITY COUNCIL <br /> <br />TO: <br /> <br />John Jermanis, City Manager <br /> <br /> <br />DATE: <br /> <br />November 21,2006 <br /> <br />FROM: <br /> <br />Jesse Baloca, Finance Direc~ <br />Jayne Williams, City Attorney <br /> <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br /> <br />RESOLUTION AMENDING RESOLUTION NO. 2004-141 AND TITLE 3, CHAPTER 1 OF <br />THE SAN LEANDRO ADMINISTRATIVE CODE, AUTHORIZING THE CITY ATTORNEY <br />TO COMPROMISE AND SETTLE CLAIMS AGAINST THE CITY TO AN AMOUNT NOT <br />TO EXCEED FIFTY THOUSAND DOLLARS. <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />The Finance Committee recommended that the City Council adopt a resolution amending <br />Resolution No. 2004-141 to increase the City Attorney's authorized authority to accept, reject, <br />settle, or otherwise compromise public liability claims filed against the City from $25,000 to <br />$50,000. <br /> <br />BACKGROUND <br /> <br />Settlement Authoritv <br />. By resolution adopted by the City Council in 2004 the City Attorney, in consultation with the <br />City Manager, has administrative authority to settle claims and lawsuits filed against the City <br />up to a maximum of $25,000. <br /> <br />. The City Attorney, City Manager, and Finance Director have adequate controls for reviewing <br />case budgets and determining whether or not a case should be settled or pursued further. <br /> <br />. An increase in settlement authority to $50,000 will allow the City Attorney to settle claims <br />and lawsuits, as appropriate. All settlements above $50,000 will be presented to the City <br />Council for approval. The City Attorney will continue to provide the City Council with <br />periodic reports of all matters settled within the administrative limits. <br /> <br />. The ability of the City Attorney to settle claims and litigation expeditiously within the <br />authorized administrative settlement authority can result in lower payouts and reduced <br />exposure to the City. <br /> <br />Current Citv Council Policy <br /> <br />Resolution No. 2004-141 authorizes the City Attorney to settle claims and lawsuits, without City <br />Council approval, in an amount up to $25,000. <br />
