<br />b. Workers' Compensation Insurance <br /> <br />ACFD shall maintain Workers' Compensation Insurance as required by the <br />State of California in Employers Liability Insurance. Employers Liability Insurance <br />shall have limits of no less than $1 million per accident for bodily injury or disease. <br />The ACFD, on its own or through the County, may self-insure to the limits of <br />coverage. <br /> <br />c. Prior Workers' Compensation Claims <br /> <br />The City shall remain fully responsible for all Workers' Compensation claims <br />filed or incurred prior to July 1, 1995. The City will retain administrative control for <br />purposes of investigation and resolution of open claims filed or incurred before July <br />1, 1995, but not closed as of that date and shall retain jurisdiction over such claims <br />until resolution. New claims filed or incurred by former San Leandro firefighter <br />employees after July 1, 1995 shall be the responsibility of the County, except for <br />those claims reopened on previous claims incurred and closed before July 1, 1995. <br />Such claims shall be considered a recurrence of the prior injury. The City will be <br />responsible for payment and administration of such claims. <br /> <br />Section 9. Miscellaneous <br /> <br />a. Term <br /> <br />This Agreement is for a continuous term. It shall continue in force from 12:00 <br />a.m. on July 1, 2005, unless sooner terminated in accordance with the provisions <br />herein <br /> <br />b. Termination <br /> <br />This Agreement may be unilaterally terminated effective June 30 of any year, <br />by either party, by giving written notice of termination to the other party not later than <br />September 1 of the preceding year. <br /> <br />Within 90 days of a notice of termination by either party, a transition plan <br />shall be developed and agreed to between the City and the ACFD. The transition <br />plan shall be initiated within six (6) months of its approval. Any impact to other <br />jurisdictions as a result of the termination of this Agreement shall take place in <br />accordance with the impacted jurisdiction's next annual budget process and <br />timeline. <br /> <br />Agreement Regarding Fire and Emergency <br />Response Services - San Leandro/Alameda County <br /> <br />Page 22 of 24 <br />
