<br />The Restricted Units shall include at least twelve (12) units that are affordable to households of <br />Very Low-Income and at least thirteen (13) units that are affordable to Extremely Low-Income <br />households (each as defined in the Regulatory Agreement) as specified in Exhibit B to the <br />Regulatory Agreement. <br /> <br />3.4 Proiect Approvals. Owner acknowledges and agrees that execution ofthis <br />Agreement by Agency does not relieve Owner from the obligation to obtain all necessary <br />entitlements, approvals, and permits for the rehabilitation and operation of the Project. <br /> <br />Owner covenants that it shall: (i) obtain all necessary permits and approvals which may <br />be required by Agency, City, or any other governmental agency having jurisdiction over the <br />Project or the Property, (ii) comply with all conditions of approval that may be issued in <br />connection with the issuance of such permits, (iii) comply with all mitigation measures imposed <br />in connection with any environmental review of the Project, and (iv) not commence <br />rehabilitation of the Project prior to issuance of necessary building permits. <br /> <br />3.5 Fees. Owner shall be solely responsible for, and shall promptly pay when due, all <br />customary and usual fees and charges of City in connection with obtaining building permits and <br />other approvals for the Project, including without limitation, those related to the processing and <br />consideration of amendments, if any, to the current entitlements, any related approvals and <br />permits, environmental review, architectural review, historic review, and any subsequent <br />approvals for the Project or the development of the Property. <br /> <br />3.6 Rights of Access. For the purpose of ensuring that the Project is operated in <br />compliance with this Agreement, the Regulatory Agreement, the Agency Loan Documents and <br />the City Loan Documents, Owner shall permit representatives of the Agency and the City to <br />enter upon the Property to inspect the Project following 24-hours written notice (except in the <br />case of emergency in which case such notice as may be practical under the circumstances shall <br />be provided). <br /> <br />3.7 Compliance with Laws. Owner shall carry out the operation ofthe Project in <br />confoffility with all applicable local, state and ft:derallaws, ordinances, rules and regulations, <br />including without limitation, all applicable local, state and federal occupational, safety, health <br />and labor standards. <br /> <br />3.8 Equal Opportunity. During the rehabilitation of the Project, there shall be no <br />discrimination on the basis ofrace, color, religion, creed, sex, sexual orientation, marital status, <br />ancestry or national origin in the hiring, firing, promoting or demoting of any person engaged in <br />construction ofthe Project, and Owner shall direct its contractors and subcontractors to refrain <br />from discrimination on such basis. <br /> <br />3.9 Prevailing Wage Requirements. To the extent applicable to the Project, Owner <br />and its contractors and agents shall comply with California Labor Code Section 1720 et seq. and <br />the regulations adopted pursuant thereto ("Prevailing Wage Laws"), and shall be responsible for <br /> <br />818642.2 <br /> <br />7 <br />
