IN THE CITY COUNCIL OF THE OF 'fHE CITY OF SAN LEANDRO RESOLUTION NO. 2006 - A RESOLUTION APPROVING AN O\VNER PARTICIPATION AGREEMENT (OPA) BETWEEN THE CITY OF SAN LEANDRO AND JOHN AND MUSA FRANCISCO, O\VNERS OF VILA CERE/A RESTAURANT,FOR THE DEVELOPMENT OF PROPERTY LOCATED AT I04l~1045-l05l MACARTIIUR BOULEVARD (APN'S 076-0350-007-01 AND 076-0350- 008-00) RECIT ALS WHEREAS, City of San Leandro (the "City"), acting with the Redevelopment Agency ofthe City o[San Leandro (the "Agency"), desires to alleviate blight in theWest San Leandro/MacArthur Boulevard Redevelopment Project Area (the "Project Area") by encouraging the development of new uses in the Project Area. WHEREAS, the City desires to encourage land uses that are consistent with the Project Area and compatible with sUlTounding uses. WHEREAS, John and Musa Francisco (the "Owner") desires to design, develop and construct improvements necessary to upgrade the Vila Cereja Restaurant on MacArthur Boulevard, which is located within the Project Area. WHEREAS, the City, Agency and the Owner have negotiated the Owner Participation Agreement whereby the Owner shall further develop the property. WHEREAS, the City finds and declares that the Owner Participation Agreement will assist in preventing the spread of blight in the Project Area, through the provision of upgraded construction and new employment opportunities in the Project Area and by pem1itting the property to be developed in a manner compatible and consistent with the existing Implementation Plan and Redevelopment Plan for the Project Area. WHEREAS, the City finds and declare that environmental review of this Agreement is not required pursuant to CEQA Guidelines Section 15332. NOW, THEREFORE, the City Council of the City of San Leandro hereby approves the Owner Participation Agreement and a grant not to exceed $350,000 to John Francisco for identified improvements, and directs the City Manager to execute the Owner Participation Agreement and any and all other documents necessary to implement the terms and conditions thereof.
