<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2006-088 <br /> <br />(2811 ) <br /> <br />RESOLUTION ACCEPTING THE ENGINEER'S REPORT FOR <br />FiSCAL YEAR 2006-07 FOR THE HERON BAY MAINTENANCE ASSESSMENT <br />DISTRICT, ASSESSMENT DISTRICT NO. 96-3 <br /> <br />Recitals <br /> <br />WHEREAS, the City Council, pursuant to the provisions of the San Leandro Municipal <br /> <br />Code, Chapter 5, Title II (hereaf't:cr referred to as the "Code") did order the Engineer, NBS <br /> <br />Government rinance Group, to prepare and fIle a report in accordance with the Code, in <br /> <br />connection with the proposed levy and collection of assessments ror the district known and <br /> <br />designated as thc J-Ieron Bay Maintenance Assessment District (Assessment District No. 96-3) <br /> <br />(hereafter relerred to as the "District"), l'or the l~scal year commencing July 1,2006, and ending <br /> <br />June 30. 2007; and <br /> <br />WIlEREAS, the Engineer has prepared and filed with the City Clerk orthe City of San <br /> <br />Leandro and the City Clerk has presented to the City Council such report entitled "Annual <br /> <br />Engineer's Report, Heron Ray Maintenance Assessment District, Assessment District No. 96-3, <br /> <br />Fiscal Year 2006-07" (hereafter relerred to as the "Report", attached hereto and made a part of); <br /> <br />and <br /> <br />WHEREAS, the City Council has carefully examined and reviewed the Report as <br /> <br />presented, and is satisl~ed with each and all orthe items and documcnts as sc1 fOJih therein, and <br /> <br />finds that the levy has been spread in accordance with the special benefits received from the <br /> <br />improvernents, operation, rnaintcnancc, ami services to be perfi.)rmcd, as set forth in said Rep0l1; <br /> <br />NOW, THEREFORE, the City COllncil of the City of San Leandro does RESOLVE as <br /> <br />l'ol!ows: <br />
