<br />EXHIBIT A <br /> <br />CITY ENGINEER'S REPORT <br />AND <br />CONDITIONS OF APPROVAL FOR <br />PARCEL MAP 8864 <br /> <br />15555 HESPERIAN BOULEVARD <br /> <br />FINDINGS <br /> <br />Pursuant to the provisions of Section 7-1-520 of the San Leandro Municipal Code, I have <br />examined Parcel Map 8864 and find that it will be in compliance with Title VII, Chapter 1 of the <br />San Leandro Municipal Code and the State Subdivision Map Act upon completion of the <br />conditions of approval listed below. <br /> <br />1. Covenants, Conditions, Restriction and Reciprocal Easements (CCRRE) that clearly <br />outline maintenance responsibilities for the existing and future utilities including future <br />installation of storm water treatment measures shall be recorded concurrently with the <br />recordation of the Parcel Map. <br /> <br />2. The Underground Utility Conversion fee for all parcels is $172,650.39 (181.90/ft. x <br />949.15 linear foot of street frontage). The Pro-Rata share of Parcel A is $148,479.33 and <br />Parcel C is $24,171.06. The Applicant is required to pay the Parcel C share of <br />$24,171.06 prior to recordation of the Parcel Map. However, the Parcel A share of <br />$148,479.33 shall be paid at the time of any substantial construction (Building Permit <br />issuance) or earlier, and this fee amount shall remain as such until July 1, 2007. If, for <br />any reason, the Utility Conversion fee is not paid by July 1, 2007, the fee shall be <br />adjusted based on the current fee rate at the time of building permit issuance for <br />improvements on Parcel A. <br /> <br />3. The Applicant shall pay Development Fee for Street Improvement (DFSI) of $28,421.70 <br />($8.98/sq. ft. x 3,165 sq. ft. building area) for parcel "B" (In-N-Out Burger) at the time of <br />building permit issuance. <br /> <br />Date: / t /, /00 <br />I / <br /> <br />
