<br />IN THE CITY COUNCIL OF THE OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2006-139 <br /> <br />(2888) <br /> <br />A RESOLUTION APPROVING AN OWNER PARTICIPATION AGREEMENT (OPA) <br />BETWEEN THE CITY OF SAN LEANDRO AND JOHN AND MUSA FRANCISCO, OWNERS <br />OF VILA CEREJA RESTAURANT, FOR THE DEVELOPMENT OF PROPERTY LOCATED <br />AT 1041-1045-1051 MACARTHUR BOULEVARD <br />(APN'S 076-0350-007-01 AND 076-0350-008-00) <br /> <br />RECIT ALS <br /> <br />WHEREAS, City of San Leandro (the "City"), acting with the Redevelopment Agency of the <br />City of San Leandro (the "Agency"), desires to alleviate blight in the West San LeandrolMacArthur <br />Boulevard Redevelopment Project Area (the "Project Area") by encouraging the development of new <br />uses in the Proj ect Area. <br /> <br />WHEREAS, the City desires to encourage land uses that are consistent with the Project Area <br />and compatible with surrounding uses. <br /> <br />WHEREAS, John and Musa Francisco (the "Owner") desires to design, develop and <br />construct improvements necessary to upgrade the Vila Cereja Restaurant on MacArthur Boulevard, <br />which is located within the Project Area. <br /> <br />WHEREAS, the City, Agency and the Owner have negotiated the Owner Participation <br />Agreement whereby the Owner shall further develop the property. <br /> <br />WHEREAS, the City finds and declares that the Owner Participation Agreement will assist in <br />preventing the spread of blight in the Project Area, through the provision of upgraded construction <br />and new employment opportunities in the Project Area and by permitting the property to be <br />developed in a manner compatible and consistent with the existing Implementation Plan and <br />Redevelopment Plan for the Proj ect Area. <br /> <br />WHEREAS, the City finds and declare that environmental review of this Agreement is not <br />required pursuant to CEQA Guidelines Section 15332. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro hereby approves the <br />Owner Participation Agreement and a grant not to exceed $350,000 to John Francisco for identified <br />improvements, and directs the City Manager to execute the Owner Participation Agreement and any <br />and all other documents necessary to implement the terms and conditions thereof. <br />
