PUBLIC HEARINGS <br /> <br />Public Hearing Comments are limited to 5 minutes per person, subject to adjustrncnt by the <br />Mayor. When you address the City Council, you should fill out a speaker card and submit it <br />to the City Clerk so thc order of speakers may be determined and an oDlcial record or names <br />and addresses obtained. <br /> <br />A Matter of Proposed Extension or Intcrim Urgency Ordinance (Ordinance No. 2002- <br />(29) to July 31, 2004, or until thc Proposed Zoning Code Amendments Arc Adopted, <br />Whichever Comcs First, Prohibiting Consideration and Approval of Use Pem1its, <br />Variances, Building Pemlits, or Other Entitlements for All New Fast-Food <br />Restaurants in the CD Commercial Downtown Zoning District (continues the <br />moratorium on all new fast-food rcstaurants in the CD Commercial Downtown <br />District, in order to allow additional tirnc lor the City Council to consider further <br />policy options). <br /> <br />This being the time and place for the Public Hearing on the above mattcr, City <br />Manager John Jennanis introduced Community Development Director Hanson Ham. <br />Mr. IIom nalTated a short PowerPoint prcsentation giving baekground on the matter, <br />issues tl)r Council consideration raised at the City Council Public Hearing on <br />Decemher 15, 2003 and recommendations for CUlTent and future actions. <br /> <br />Councilmernbcr Badger asked for clarincation on the "southern downtown retail <br />distriet." Mr. HOll1 stated under the East 14th South Area Development Strategy, the <br />entire corridor is clllTently zoned Cc. StalTwil1 be bringing forward to the Council a <br />proposal to divide the East 141h area into distinct commercial/mixed use/residential <br />districts. Thc area at the far north end of the study area has been tentatively labeled <br />the "southern downtown retail district," which is meant to be a transition area that <br />emphasizes retail uses and is not part of the core downtown area. The Coul1cil will <br />need to determine i I' it wishes to allow r~lst rood restaurants in this area. <br /> <br />Councilmember Nardine asked about the additional criteria for defining "fast rood" <br />other than square (()otage. Mr. Ham stated staff has notcd Council's interest in <br />considering an expanded definition to include other establishments such as juice hars <br />and colTeehouses. Coul1cilmemher Nardine asked ahout a criterion for dining-in <br />versus takeout. Mr. 110m noted that this criterion is already considered in the ClllTent <br />dennitiol1. He further noted that the only denning criterion between small- and large- <br />scale fast 100LI establishmcnts is square footage. <br /> <br />The Hearing was then opened to the public. <br /> <br />Lou Filipovich, ] 5376 Laverne Drive, addressed the City Council regarding the <br />minutes of December 15, 2003, stating he raised a point of order aner the close of the <br />public hearing and was not rccognized or allowed to speak at that time.
