<br />lVIINUTES <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-June 7, 2004 <br /> <br />Page 13 <br /> <br />Vice Mayor Badger asked if the issue with Jake's Lion has been resolved. Mr. Jermanis <br />recalled that there was discussion about changing the plans to allow for the expansion of <br />Jake's Lion. However, staff received a letter from the senior engineer at East Bay <br />Municipal Utility District (EBMUD) stating that construction of a building over the <br />existing water line would not be allowed. After receipt of the EBMUD letter, staff <br />retulned to the original design, and the construction plans being presented for Council <br />approval are the original plans. Mr. J ermanis indicated that if it was anticipated that <br />EBMUD would change its decision and allow the construction, Council could defer the <br />construction bids. <br /> <br />Vice Mayor Badger noted that a meeting has been scheduled to try to settle the issue. <br />Mayor Young asked how long the meeting would delay the proj ect. Mr. J ermanis <br />indicated that if EBMUD affirms that construction cannot take place on the property, <br />staff could bring the iten1 back on June 21. Ifit was determined that something could be <br />done, Engineering and Transportation would need to redesign the plans, and the project <br />would be delayed. <br /> <br />Vice Mayor Badger expressed interest in waiting for the outcome of the meeting before <br />moving forward. <br /> <br />Mayor Young asked if Jake Francisco, owner of Jake's Lion, has requested a delay. Mr. <br />Jermanis stated that staff has met with Mr. Francisco. He described Mr. Francisco's <br />plans to expand his restaurant, utilizing some of the open space created by relocating the <br />median and changing the street alignn1ent. Mr. J ermanis noted the problem with Mr. <br />Francisco's plan is that there are two major water lines running parallel to the curb line. <br />The cost to relocate the lines is about $250,000 which is cost-prohibitive for EBMUD. <br />The Ineeting mentioned by Vice Mayor Badger was arranged with Jake Francisco and <br />officials from EBMUD to attempt to resolve the problem. <br /> <br />Mr. Jermanis described the original plan and the tight timeframe for the project. He <br />noted that if there is a delay involving the redesign of the plans and specifications, it <br />could impact the overall timefran1e for development of the area. He suggested that if <br />EBMUD determined that the water lines could be moved, the Engineering Department <br />Inay be able to do an addendum to the plan. <br /> <br />Vice Mayor Badger indicated that he would support the resolution if an addendum <br />could be made in the event there is a change in EBMUD' s determination to allow the <br />expansion of Jake's Lion. Mr. J ermanis stated that at the time an addendum is brought <br />to the Council, staff will also present the costs associated with the changes. <br /> <br />Councilmember Glaze asked who would be responsible for the costs of the additional <br />Engineeling work. Mr. J ermanis responded that the determination could be made by the <br />Council at the time the addendum is presented. <br /> <br />.
