<br />MINUTES Page 8 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-September 20, 2004 <br /> <br />Authorizing the Agency to Acquire an Easement at 1267 W ashington Avenue in <br />San Leandro, as well as a Temporary Construction Easement; and Authorizing the <br />Executive Director to Execute a Grant of Easement and Temporary Construction <br />Easement. (1485) <br /> <br />. Resolution No. 2004-145, Resolution of the City Council of the City of San <br />Leandro Making Health and Safety Code Section 33445 Findings; and <br />Authorizing the Redeveloplnent Agency of the City of San Leandro to Use <br />Agency Funds to Acquire an Easement at 1267 W ashington Avenue in San <br />Leandro, as well as a Telnporary Construction Easement and to Install <br />Inlprovelnents. Resolution Authorizing the City Manager to Execute a Consulting Services Agreement <br />with HdL Software LLC for the Purchase of a New Business License Software <br />Application (replaces the existing business license software application). ITEMS REMOVED FROM CONSENT CALENDAR <br /> <br />Public comments are limited to 3 minutes per person per item. <br /> <br />8.B. Ordinance No. 2004-020, an Ordinance Amending Chapter 2, Title 2 of the San <br />Leandro Municipal Code Relating to Business License Enforcement. (1203) <br /> <br />Vice Mayor Badger observed that the definition of a firearms dealer as described in the <br />ordinance seems to suggest that a dealer which sells only rifles and shotguns would not <br />fall under this category. <br /> <br />Deputy Finance Director CYnthia Battenberg clarified that the reason for the anlendlnent <br />to the section was to distinguish businesses which substantially sell or transfer firearms <br />from spoliing goods or department stores which do not deal primarily in firearms. <br /> <br />Police Chief Kitchen stated that this ordinance relates to City business licenses, and any <br />firearms dealer must also have a federal firearms license in order to sell or transfer <br />firearms. Mr. J ermanis noted that businesses which sell firearms would still require a <br />business license but would not necessarily be classified as a firearms dealer. <br /> <br />Councilmember Nardine asked if the gun tax is collected on rifles sold in sporting <br />goods stores. Mr. Jermanis indicated that the gun tax only applies to handguns, and <br />rifles and shotguns are exempt frOln the handgun tax. <br /> <br />- Adopted <br /> <br />M1S/C Badger and Grant.
