<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2006-099 <br /> <br />(3097) <br /> <br />RESOLUTION APPROVING FINDINGS FOR <br />VESTING TENTATIVE MAP TRACT 7810 <br />1537 HAYS STREET <br />ALAMEDA COUNTY ASSESSOR'S PARCEL NUMBER 75-12-7 <br />D. LANGON, LANGON HOMES (APPLICANT AND PROPERTY OWNER) <br /> <br />Fin din gs <br /> <br />The City Council of the City of San Leandro finds that the proposed Inap, together with the <br />provisions for its design and improvenlents, are as follo\vs: <br /> <br />A. The proposed Inap will be consistent with the General Plan in that it provides for <br />mediUlll-density residential as a conditionally penllitted use in an area designated for <br />high-density residential develoPlnent. The proposed 11ledium-density would be <br />compatible with the existing high-density residential developlllent adjacent to the south <br />of the site and the low-density residential developlnent in the ilnnlediate adj acent area. <br /> <br />B. The design and inlprovelnents of the proposed subdivision is consistent with the General <br />Plan in that it includes an orderly division of parcels which are adequately served by <br />streets and with drainage for residential development. In addition the project fulfills a mix <br />of residential developnlent types in the City, including single-fanlily honles on a variety <br />of lot sizes, as well as townhOllles, row houses, live-work units, planned unit <br />developnlents and Inlllti-fanlily housing. <br /> <br />C. The site is physically suitable for residential developnlent in that it is relatively flat, and <br />there are no known problelns regarding, cultural, historical or scenic aspects. Soil <br />stability will be reviewed thoroughly prior to issuance of building penllits. Some of the <br />ne\v plant material proposed will be native variety or drought tolerant type plants. <br /> <br />D. The proposed density of develoPlnent of one dwelling unit per 2,500 square feet (17 <br />units/acre) "vill be conditionally compatible with high density designation and nearby <br />existing high- and low-residential density development. <br /> <br />E. The design of the subdivision or proposed inlprovelnents are not likely to cause <br />substantial environnlental dalllage or substantially and avoidably injure fish or wildlife or <br />their habitat. This project to construct six residential units is categorically exen1pt fron1 the <br />Cabfon1ia Environmental Quality Act (CEQA) per CEQA Guideline Article 19, <br />Categorical Exell1ption, Sections 15303 (b) and 15332. Furthermore, the rezoning is <br />exen1pt from CEQA, per CEQA Guideline, Section 15061 (b) (3), where it can be seen <br />with certainty that there is no possibility that the rezoning in question nlay have a <br />significant effect on the environment. <br />
