<br />AGREEMENT BETWEEN EAST BAY DISCHARGERS AUTHORITY, AND <br />THE CITY OF SAN LEANDRO REGARDING WATER RECYCLING <br /> <br />Reci tals <br /> <br /> <br />WHEREAS, East Bay Dischargers Authority (EBDA) is a Joint Powers Agency <br /> <br /> <br />(comprised of the cities of Hayward and San Leandro, Oro Loma Sanitary District, Castro <br /> <br /> <br />Valley Sanitary District, and Union Sanitary District) which owns and operates facilities for the <br /> <br /> <br />collection, transmission, treatment, and disposal of wastewater; and <br /> <br /> <br />WHEREAS, EBD A is the holder of a National Pollutant Discharge Elimination System <br /> <br /> <br />(NPDES) permit issued by the Regional Water Quality Control Board serving Alameda County <br /> <br /> <br />and other parts of the San Francisco Bay area; and <br /> <br /> <br />WHEREAS, the City of San Leandro (City) is a charter city which owns and operates <br /> <br /> <br />facilities for the collection, transmission and treatment of wastewater which is transmitted to the <br /> <br /> <br />EBDA system for ultimate disposal into the San Francisco Bay; and <br /> <br /> <br />WHEREAS, City seeks to "tap into" EBDA's forcemain and to withdraw wastewater <br /> <br /> <br />for reuse as recycled water under the terms of this Agreement. <br /> <br />NOW THEREFORE, the parties agree as follows: <br />1. Approval to "Tap Into" EBDA's Force main <br /> <br />City is hereby granted permission to "tap into" EBDA's forcemain at a location agreed <br /> <br /> <br />to by the parties for the purpose of withdrawing EBDA's wastewater to be used by City for <br /> <br /> <br />recycling purposes under the terms and conditions of this Agreement. <br /> <br /> <br />2. Plans and Specifications <br /> <br /> <br />The City, in consultation with EBDA, will develop plans and specifications for the "tap <br /> <br /> <br />in" connection which will be reviewed by a qualified consulting civil engineer.
