<br />l\flNUTES Page 9 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-September 15, 2003 <br /> <br />Barry Luboviski, Building Trades Council, addressed the City Council, commenting <br />on a resolution he distributed to the Council. It was a resolution passed by the State <br />Legislature in support of prevailing wage. Mr. Luboviski urged the Council to amend <br />the proposed resolution to include additional provisions. <br /> <br />Stu Helfer, Teamsters Local 853, addressed the City Council In support of the <br />previous speaker's comments. <br /> <br />Matt Maloon, Business Representative for IBEW 595, addressed the City Council <br />regarding the importance of prevailing wage to the working families of San Leandro. <br /> <br />Councilmember Santos stated he received notification that the State Legislature passed <br />a resolution which makes clear its intent for charter cities to pay prevailing wage on all <br />projects over $1,000. <br /> <br />Councilmember Santos moved adoption of the resolution with amendments <br />incorporating the recent decisions by the State Legislature and California Court of <br />Appeal. The motion was seconded by Vice Mayor Glaze. <br /> <br />Discussion on the motion: <br /> <br />Councilmember Stephens asked for clarification on the meaning of "efforts to overturn <br />or depublish." City Attorney Williams provided definitions of the terms. <br /> <br />Mayor Young asked about the impact of changing the $5,000 limit to $1,000. City <br />Manager J ermanis stated staff has not had the opportunity to review the recent <br />legislative action. City Attorney Williams noted that adding the reference to a $1,000 <br />limit would require an amendment to the Municipal Code. Ms. Williams further noted <br />that the Council's actions should address the prevailing wage issue specifically as it <br />pertains to chartered cities. <br /> <br />Vice Mayor Glaze suggested the Council could adopt the resolution with the proposed <br />revisions now and amend the Municipal Code to lower the project limit to $1,000 later. <br />Councilmember Santos voiced his agreement with this idea. <br /> <br />Councilmember Grant asked if State law supersedes the local law on the $1,000 limit. <br />Ms. Williams noted that as a charter city, San Leandro can adopt its own limit. <br /> <br />Mayor Young suggested that since the City Attorney has asked for additional time to <br />review the legislation, the Council could adopt the original resolution and amend it at a <br />later date. Councilmember Santos expressed a preference for adopting the resolution as <br />amended. Vice Mayor Glaze suggested that after reviewing the legislation, if the City <br />Attorney determines any provisions in the resolution to be problematic, the Council can <br />further amend the resolution. <br /> <br />City Attorney Williams stated she will provide the Council with copies of the legislation <br />and a summary of the Long Beach case. <br />
