<br />Business Center Dr. Summary Vacation <br /> <br />2 <br /> <br />February 20, 2007 <br /> <br />The State of California Streets and Highway Code sets the authority and procedures for street, <br />highway, and easement abandonment. The procedure for summary vacation is outlined in Title <br />V, Chapter 4, of the San Leandro Municipal Code and in Part 3, Division 9 of the Streets and <br />Highway Code. Per Chapter 4 of Part 3, Division 9, Section 8333 of the Streets and Highway <br />Code, the legislative body of the local agency may summarily vacate a public service easement if <br />the date of dedication or acquisition is less than five years, and more than one year, immediately <br />preceding the proposed vacation, and the easement was not used continuously since that date. <br />These conditions are clearly satisfied, since the portions of the public utility easement to be <br />abandoned are currently not occupied by any utilities. <br /> <br />Current City Council Policy <br /> <br />Not Applicable <br /> <br />Previous City Council Action(s) <br /> <br />.
