<br />Consultant to the City prior to City acceptance of the work. Said bond shall be in <br />the form approved by the City and executed by a surety company or companies <br />satisfactory to the City, in the amount of ten (10) percent of the contract price or <br />$1,000.00, whichever is greater. Said bond shall remain in force for the duration <br />of the guarantee period specified. <br /> <br />Section 11. PUBLIC INFORMATION <br /> <br />The City shall be solely responsible for coordinating public information materials and activities <br />related to the dedication of the Monument. Consultant shall not organize or promote any public <br />advertisement or promotion of the Monument without prior approval of City. <br /> <br />Section 12. 'UNINTERRUPTED USE OF CIVIC CENTER PLAZA DURING <br />INSTALLATION <br /> <br />Prior to commencement of installation of the Monument, Consultant and City shall agree in <br />writing to a confirmed schedule of installation dates and times. Installation of the Monument <br />shall not conflict with any previously scheduled uses of the Civic Center Plaza, nor shall it <br />interrupt the use of the Civic Center Plaza for any previously scheduled event. <br /> <br />Section 13. LEGAL REQUIREMENTS. <br /> <br />13.1 Governin2 Law. The laws of the State of California shall govern this <br />Agreement. <br /> <br />13.2 Compliance with Applicable Laws. Consultant and any contractors shall <br />comply with all laws applicable to the performance of the work hereunder. <br /> <br />13.3 Other Governmental Re2ulations. To the extent that this Agreement may be <br />funded by fiscal assistance from another governmental entity, Consultant and any <br />contractors shall comply with all applicable rules and regulations to which City is <br />bound by the terms of such fiscal assistance program. <br /> <br />13.4 Licenses and Permits. Consultant represents and warrants to City that <br />Consultant and its employees, agents, and any contractors have all licenses, <br />permits, qualifications, and approvals of whatsoever nature that are legally <br />required to practice their respective professions. Consultant represents and <br />warrants to City that Consultant and its employees, agents, any contractors shall, <br />at their sole cost and expense, keep in effect at all times during the term of this <br />Agreement any licenses, permits, and approvals that are legally required to <br />practice their respective professions. In addition to the foregoing, Consultant and <br />any contractors shall obtain and maintain during the term of this Agreement valid <br />Business Licenses from City. <br /> <br />13.5 Nondiscrimination and EQual Opportunity.
