<br />DRAFT MINUTES Page 11 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-March 5, 2007 <br /> <br />Chief Attarian commented that the officers will exercise their discretion in the <br />interpretation and enforcement of the ordinances and will keep in mind the spirit and <br />purpose of the law, not just the letter of the law. Chief Attarian pointed out that the <br />enforcement process allows for ample time for education and voluntary compliance on <br />the part ofthe violator, and there should be no need for a special warning period prior to <br />implementing the new code amendments. <br /> <br />Public Comments on Item 1O.A.: <br /> <br />Merv Rocha, San Leandro resident, addressed the City Council, expressing support <br />for the new ordinance amendments and commenting that he feels too much time is <br />given to violators. <br /> <br />Shirley Rocha, San Leandro resident, addressed the City Council, thanking the <br />Council for strengthening the ordinances. Mrs. Rocha invited new Councilmember <br />ProIa to drive through the Davis West neighborhood. <br /> <br />Lawrence McGeorge, San Leandro resident, addressed the City Council, <br />commenting that he and his neighbors have attempted since 2001 to address the many <br />commercial vehicles stored on a neighbor's property and on the street on W est Avenue <br />134th. Mr. McGeorge expressed support for the ordinances. <br /> <br />Annabell McGeorge, San Leandro resident, addressed the City Council, commenting <br />favorably on the Council's passage of the amendments to the ordinances. <br /> <br />End of Public Comments on Item 1O.A. <br /> <br />Chief Attarian responded to questions from the Council. <br /> <br />Regarding Mr. Rocha's comment, Vice Mayor Grant expressed agreement that the <br />enforcement timeline is too long, and asked if there is any way to shorten it. Mr. <br />J ermanis indicated that the time line has already been streamlined. Chief Attarian <br />commented that the current time1ine allows for due process and is workable for the <br />department. Mr. Jermanis indicated that staff will report back to the Council with an <br />update on the progress of implementing the ordinances at a future meeting. <br /> <br />Councilmember Starosciak thanked Chief Attarian for implementing these new laws <br />with existing resources. <br /> <br />B. Report on Closed Session Actions Taken <br /> <br />City Attorney Williams reported that the City Council met in closed session this evening <br />and took final action on Gradetech v. City of San Leandro. This item is related to Item <br />8.G. on tonight's agenda. Councilmember Starosciak was not present at the closed <br />session. The Council voted 6-0 to authorize the City Attorney to enter into a settlement <br />that would resolve the litigation filed by Gradetech against the City of San Leandro in <br />connection with the DavislDoolittle intersection improvement project.
