<br />be limited to the following: employment, upgrading, demotion, or
<br />transfer; recruitment or recruitment advertising; layoff or
<br />termination; rates of payor other forms of compensation; and
<br />selection for training, including apprenticeship. Permittee
<br />agrees to post in conspicuous places, available to employees and
<br />applicants for employment, notices to be provided by the Port's
<br />Equal Opportunity Employment Officer setting forth the provisions
<br />of this paragraph;
<br />
<br />b) That Permittee shall, in all solicitations or advertisements for
<br />employees placed by or on behalf of Permittee, state that all
<br />qualified applicants will receive consideration for employment
<br />without regard to race, color, religion, sex, actual or perceived
<br />sexual orientation, national origin, age, physical handicap or
<br />disability as set forth in the Americans With Disabilities Act of
<br />1990, or veteran's status;
<br />
<br />c) That Permittee will send to each labor union or representative of
<br />workers with which he has a collective bargaining agreement or
<br />other contract or understanding, a notice, to be provided by the
<br />Port's Equal Opportunity Employment Officer, advising the labor
<br />union or workers' representative of Permittee's commitments under
<br />this paragraph, and shall post copies of the notice in
<br />conspicuous places available to employees and applicants for
<br />employment;
<br />
<br />d) That Permittee shall not discriminate by segregation or otherwise
<br />against any person or persons because of race, color, religion,
<br />sex, actual or perceived sexual orientation, age, national
<br />origin, physical handicap or disability as set forth in the
<br />Americans With Disabilities Act of 1990, or veteran's status in
<br />furnishing, or by refusing to furnish, to such person or persons
<br />the use of any public facility upon the Premises, including any
<br />and all services, privileges, accommodations, and activities
<br />provided thereby;
<br />
<br />e) That in the construction of any improvements on, over or under
<br />such land and the furnishing of services thereon, no person, on
<br />the grounds of race, color, national origin, shall be excluded
<br />from participation in, denied the benefits of, or otherwise be
<br />subjected to discrimination;
<br />
<br />f) That Permittee shall use the Premises in compliance with all
<br />other requirements imposed by or pursuant to Title 49, Code of
<br />Federal Regulations, Department of Transportation, Subtitle A,
<br />Office of the Secretary, Part 21, Nondiscrimination in
<br />Federally-assisted Programs of the Department of
<br />Transportation-Effectuation of Title VI of the Civil Rights Act
<br />of 1964, and as said regulations may be amended;
