<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2007- <br /> <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A <br />RIGHT-OF-ENTRY AND INDEMNITY AGREEMENT BETWEEN THE CITY OF <br />SAN LEANDRO AND THE PORT OF OAKLAND TO CONSTRUCT THE BAY TRAIL <br />PEDESTRIAN/BICYCLE BRIDGE WITH CONNECTING TRAIL <br /> <br />Reci tal <br /> <br />WHEREAS, the City of San Leandro (City) has negotiated a Right-of-Entry and <br /> <br />Indemnity Agreement with the Port of Oakland (Port) to complete construction of the <br /> <br />pedestrianlbicyc1e bridge crossing ofthe San Leandro slough and connecting trail segment; and <br /> <br />WHEREAS, the City will complete the construction and then turn the completed trail <br /> <br />segment over to the Port. The Port will subsequently maintain all improvements on its property <br /> <br />and the City will maintain all improvements on City property; and <br /> <br />WHEREAS, completion of this agreement will facilitate the finishing stages of the <br /> <br />environmental documents and acquisition of grant funding of the project; and <br /> <br />WHEREAS, the City Manager has reviewed the agreement and recommends approval. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> <br />follows: <br /> <br />1. That the Right-of-Entry and Indemnity Agreement between the City of San <br /> <br />Leandro and the Port of Oakland attached hereto as Exhibit A is hereby approved. <br /> <br />2. That the City Manager is hereby authorized to execute said agreement and any <br /> <br />additional documents necessary to facilitate the transaction. <br /> <br />Introduced by Councilmember <br /> <br />and passed and adopted <br /> <br />this 19th day of March 2007, by the following called vote: <br />
