before commencement of any such work, delivery of materials, or staging of construction or demolition activity. City shall have the right to post, and maintain on the premises, any notices of non~responsibility provided for under applicable law, and to inspect the premises in relations to the construction or demolition at all reasonable times. 5.2 Notice of Chanqes in Plans. Upon completion of any construction of demolition, City shall give Lessee notice of significant changes in plans or specifications made during the course of the work. 6. INDEMNITY. Lessee agrees to indemnify, defend and hold harmless City, its directors, officers, employees, contractors, and agents from and against all claims, causes of action, damages, liabilities, injuries, actions, costs and expenses (including reasonable attorney's fees and costs) arising from or related to this Agreement. 7. MODIFICATION. This Agreement may be modified only by a subsequent writing, signed by both parties. 8. FORCE MAJEURE. In the event that either the Estudillo Garage or the Hyde Street Parking Lot is affected directly by fire, earthquake or other acts of God, strike, lockout, acts of public enemy, riot, or insurrection, Landlord is not responsible for providing replacement parking to Lessee. 9. POSSESSORY INTEREST. Lessee is advised that under Revenue and Taxation Code Section 107.6 a possessory interest subject to property taxation may be created by this Agreement. Lessee hereby agrees that if such possessory interest is created and such interest is subject to property taxation, Lessee shall be responsible for the payment of said property taxes levied on any such interest.
