<br />Excerpt Draft Minutes of the January J 7, 2007 Joint RA C Meeting <br /> <br />Page 2 of2 <br /> <br />the creation of a special review overlay district, was the best way to address the issue. <br />Staff identified 13 areas for consideration for designation as a special review overlay <br />district. Pollart described the criteria developed for the overlay area which include, but <br />are not limited to: 1) a site not located along a major commercial corridor; 2) a site not <br />designated Industrial General (IG) or IP; 3) a site which is a minimum of two acres in <br />size; 4) a site which abuts or is within J/4 mile of an arterial street; and 5) a site which is <br />vacant or currently underutilized. Pollart stated that the next step in addressing this issue <br />will be for City staff to prepare an Initial Study/Negative Declaration for rezoning of <br />identified properties within the Assembly Use Overlay District and schedule this issue for <br />Planning Commission and City Council consideration at meetings tentatively scheduled <br />in January and February, respectively. <br /> <br />An extensive discussion then ensued among RAC members, focusing on five main i s. <br />These issues included how the zoning code amendment would affect S ea ' s <br />industrial base, the legal issues involving limiting Religious Asse s e noticing <br />of the affected businesses, which study areas should or a e incl d d in the <br />overlay and how to deal with the a property after a non-pr fi e has vacated. <br /> <br /> <br />m three separate motions to address distinct issues which had come to light <br />e discussions. <br /> <br />M1Jorgenson, S/Kellman that the RAe concurs with the PCIBZA recommended <br />approach to create a special overlay district for assembly uses. Carried 8-0 with <br />Dlugosh abstaining. <br /> <br />M1Gilcrest, SlBattinich to recommend that properties which are occupied by a non- <br />profit assembly use relocating within the City be encouraged to return to a taxable <br />use once the property is vacated. Carried 8-0 with Dlugosh abstaining. <br /> <br />M1Battinich, S/Jorgenson to recommend that Overlay Area #5 (Washington Ave) be <br />removed from the proposed zoning code amendment. Carried 5-1 with Dlugosh and <br />Kellman abstaining. <br />
