<br />16) Prevailing <br />Requirements: <br /> <br />Wage <br /> <br />And <br /> <br />Other <br /> <br />Permittee <br /> <br />Construction <br /> <br />Related <br /> <br />a) Basic Requirements: <br /> <br />Permittee agrees that: <br /> <br />i) In Permittee's performance of any work on the <br />this Agreement, Permittee shall comply with <br />wage requirements of this Agreement: <br /> <br />Premises under <br />the prevailing <br /> <br />(1) The Public Work Prevailing Wage Requirements, which <br />are the applicable prevailing wage requirements of <br />California Labor Code Sections 1720 et seq. and Port <br />Ordinance No. 1606, as amended, and which generally apply <br />to construction, costing more than $1,000.00, which is made <br />on or to Port property and the cost of which is paid for in <br />whole or in part by the Port's advance or reimbursement to <br />Permi ttee or by credit against rent or other sums due the <br />Porti and <br /> <br />(2) The Private Work Prevailing Wage Requirements of this <br />Agreement which generally apply to all construction, other <br />than construction to which the Public Work Prevailing Wage <br />requirements apply, which is made on or to Port property, <br />costing more than $50,000.00. The Private Work Prevailing <br />Wage Requirements shall not apply to tenant improvements <br />costing les s than $ 50,000.00, nor to tenant improvements <br />for which the initial building permit for such work is <br />issued more than one year after the certificate of <br />occupancy is approved on the core and shell. The <br />$50,000.00 cost shall be adjusted annually pursuant to the <br />Consumer Price Index ("CPIU). <br /> <br />ii) "Construction" as used in this Section 42 shall apply to <br />construction, alteration, demolition or repair work, and the <br />laying of carpet and maintenance work, provided, that Private <br />Work Prevailing Wage Requirements shall not apply to <br />maintenance work. "Construction" includes all construction of <br />building core and shell, tenant improvements and public works <br />that are within the customary jurisdiction of the construction <br />trades and crafts, whether performed on- or off-site. <br />Off-site work, performed by Materialmen, as defined under <br />California Law, is not included in the term "Construction". <br /> <br />b) Addi tional Prevailing Wage provisions: The following provisions <br />of this subsection apply only if, and to the extent that, the <br />prevailing wage requirements are applicable. <br /> <br />Oyster Bay Slough Trail Improvaments <br />RIGHT-OF-ENTRY AND <br />INDEMNITY AGREEMENT <br />l02681.v6 <br /> <br />15 <br />
