<br />Upon failure to so file such certificate or endorsement, the Port may <br />terminate this Agreement. <br /> <br />Permittee shall also provide to the Port evidence of: <br /> <br />k2J <br />k2J <br />o <br />o <br />o <br /> <br />statutory worker compensation coverage under California law <br />employer's liability coverage for no less than One Hundred <br />Thousand Dollars ($100,000) <br />endorsements evidencing Longshoreman and Harbor Workers 1 <br />coverage and Jones Act coverage if applicable. <br />subrogation waiver <br />Fire Legal Liability insurance in the amount of ONE HUNDRED <br />THOUSAND AND 00/100 DOLLARS ($100,000.00) also is required. <br /> <br />9. Termination: Permittee agrees immediately upon termination of <br />this Agreement, and at no cost or expense to the Port, to remove itself <br />and all persons, movable equipment, debris and other materials <br />(including unused construction, fill or piling materials) from the <br />Premises which were not on the Premises before Permittee entered upon <br />the Premises under or in contemplation of this Agreement. Permittee <br />agrees that all structures, piling, piers, locks, bolts, repairs, <br />al terations, equipment and/or improvements affixed to or made upon <br />said Premises by either of the parties hereto, shall be and become the <br />property of the Port, and shall remain upon and be surrendered with <br />the Premises as part thereof upon termination of this Agreement, save <br />that Permittee may at the termination of this Agreement, if Permittee <br />is not in default under any of the provisions of this Agreement, and <br />if the Premises are restored to their original or to a better <br />condition, remove its apparatus, conveyors, movable partitions and <br />other trade fixtures heretofore and/or hereafter placed thereon by it; <br />provided, the provisions of this paragraph may be waived by resolution <br />of the Board upon application prior to the making of any such <br />improvements. <br /> <br />10. Applicable Laws, Regulations and Approvals: Permittee agrees <br />in connection with any of its activities regarding the Premises to <br />comply at no cost or expense to the Port with all applicable laws, <br />regulations, orders and permits, to coordinate its acti vi ties with the <br />Port and to govern its activities in accordance with reasonable requests <br />by the Port. All work to be performed must be approved by the Port <br />prior to commencement of work. In addition, construction or <br />installation of Trail Improvements shall not commence unless and until <br />Permi ttee, or its contractor, shall have secured, at no cost to the <br />Port, all necessary permits, including, but not limited to, building <br />permi ts, Federal Aviation Administration ("FAA") approval (s), and any <br />necessary approvals and permits from any applicable government or <br />regulatory agency including but not limited to the San Francisco Bay <br />Conservation and Development Commission, the United States Army Corps <br />of Engineers, San Francisco Regional Water Quality Control Board, <br />California Department of Fish and Game, the United States Fish and <br />Wildlife Service, and any other applicable federal, state or regional <br />agencies. Permittee agrees to comply with all terms and conditions of <br />all such applicable approvals or permits, whether secured by Permittee <br />or the Port. <br /> <br />l02681.v6 <br />
