PLN2006-00075
Amendments to Zoning Map

2

April 2, 2007

BACKGROUND

The subject properties are located between Washington Avenue and San Leandro Boulevard and
are comprised of five separate parcels. The existing conditions are as follows: 2392 Cherry Street
is used as vehicle storage and "no address" Cherry Street is vacant; 2385 Washington Avenue is
developed with a single-family home; 2395 Washington Street is developed with a warehouse
and wholesale distribution business; 2411 Washington Street is used as a vehicle storage
business and an auto repair business.

In August 2006, staff received an application requesting a rezone and Zoning Map amendment
for the two properties on the comer of Cherry Street and Hudson Lane from the existing zoning
of RD Residential Duplex and IL Industrial Light to a commercial zoning. In the future, the
applicant proposes to apply for a Conditional Use Permit for an auto repair use at the two Cherry
Street properties (2392 and "no address" Cherry Street.) Auto repair is a conditionally permitted
use in the proposed CC Zoning District. Their current auto repair use is located at 2411
Washington Avenue. The applicant currently operates the business as a tenant, and they desire to
purchase the properties on Cherry Street to locate their business. The specific auto repair use
would require a Conditional Use Permit once the rezone is approved.

DRAFT ORDINANCE

The proposed rezone and Zoning Map amendment would amend the Zoning Map to the CC
Commercial Community designation for the subject properties. The graphic attached to the
proposed ordinance shows the subject properties with the existing zoning and the proposed
zoning to CC Commercial Community.

DISCUSSION

Staff reviewed the proposal and determined that a rezone of the subject properties to a
commercial zoning district, CC Commercial Community, would provide an opportunity to
modify the zoning on those two properties and three additional properties to bring the zoning into
conformance with the existing General Plan designation, Corridor Mixed Use.

The properties would be rezoned to a zoning designation that is consistent with the General Plan,
from RD Residential Duplex and IL Industrial Limited, to CC Commercial Community. The CC
Zoning District allows for a wide range of commercial and residential uses.

The General Plan Land Use Map designates the subject property as Corridor Mixed Use. This
designation is described as "a mix of commercial and residential uses oriented in a linear
development pattern along major transit-served arterials..." The subject sites also lie within the
Central part ofthe City, as described in the General Plan on pages 3-21 to 3-22. The General Plan
states that Central San Leandro has opportunities for new residential development along
Washington Avenue, which would be facilitated by the proposed rezone. Mixed-use residential,
multi-family, and two-family residential uses are conditionally permitted in the CC District.
