<br />PLN2006-00075 <br />Amendments to Zoning Map <br /> <br />3 <br /> <br />April 2, 2007 <br /> <br />In review of the context of the Washington Street and Cherry Street properties, and their General <br />Plan Designation, staff believes that the current RD Residential Duplex and IL Industrial Limited <br />Zoning designations are not consistent with the commercial and residential context and the <br />General Plan designation. The CC Commercial Community Zoning District was selected as the <br />appropriate rezoning classification, as the majority of Washington Avenue to the north and south <br />of the site is zoned CC. In addition, the General Plan Land Use compatibility table (Table 3-2) <br />specifies that the CC district is a conditionally compatible zoning designation for Corridor Mixed <br />Use. <br /> <br />The rezone and Zoning Map amendment from RD and IL to CC would not affect the existing <br />uses of the properties. Any uses that are conditionally permitted or not allowed under the new <br />zoning district would be "grandfathered in" if no lapse in legal status occurs over a period of 180 <br />days. For example, in the case of vehicle storage at 2411 Washington Avenue, the use would no <br />longer be a conditionally permitted use. However, as mentioned above, it would be allowed to <br />remain as long as a valid business license is maintained. <br /> <br />Staff believes this proposal provides better consistency between the General Plan and the Zoning <br />Map and will provide for the potential to develop these properties with commercial or residential <br />uses that will be in harmony with the neighborhood context of existing residential and <br />commercial development. <br /> <br />Current City Council Policv <br />Not applicable. <br /> <br />Previous City Council Action <br />Not applicable. <br /> <br />City Council Committee Review and Actio.!! <br />This item was presented by staff at the February 8, 2007, Business Development Subcommittee <br />meeting. <br /> <br />Applicable General Plan Policy <br />See Discussion above. <br /> <br />Permits and/or Variances Granted <br />Not applicable. <br /> <br />Environmental Review <br />Because this proposal includes a rezone of properties, this action is subject to the California <br />Environmental Quality Act (CEQA) and an Initial Study Checklist and Negative Declaration <br />were prepared by staff. The 20-day public review period established for the Negative Declaration <br />commenced on February 2 and concluded on February 22. No comments on the Negative <br />Declaration were received. <br /> <br />Code Compliance Review <br />Not applicable. <br />
