<br />encourage historic preservation, and investment, improvement, and maintenance of historic <br />properties. <br /> <br />4-26-2000 EXPIRATION OF APPROVAL <br />A Certificate of Approval is valid for one year from the date of [mal decision unless either of the <br />following occurs: <br /> <br />1. The building permit has been issued and substantial work has begun; or <br /> <br />2. The original approving body has approved an extension. <br /> <br />4-26-2100 APPEALS OF ACTIONS REGARDING HISTORIC RESOURCES <br />An appeal of a decision of the Library-Historical Commission shall be filed pursuant to Chapter <br />1-9 of the City of San Leandro Municipal Code. <br /> <br />Decisions of the Library-Historical Commission Secretary may be appealed to the Library- <br />Historical Commission. Such appeals shall be filed with the Library Services Director within <br />fifteen (15) days of the date of the decision. <br /> <br />Decisions of the Library-Historical Commission may be appealed to the City Council. Such <br />appeals shall be filed with the City Clerk within fifteen (15) days of the date of the decision. <br /> <br />An appeal shall be scheduled before the appellate body for a decision within forty-five (45) days <br />of the City's receipt of the appeal, unless both applicant and appellant consent to a later date. <br /> <br />Appealed items shall be noticed in a manner required for the item being appealed as prescribed in <br />Section 4-26-400. <br />Any proposal regarding a designated historic resource, or potentially eligible historic resource <br />that is denied by the Library-Historical Commission, the Commission Secretary, or the City <br />Council may be presented for a new decision after: <br />1. New information is presented regarding the resource; or <br />2. The proposed project has changed significantly from that originally presented; or <br />3. Two years has passed since the original presentation date." <br /> <br />SECTION 3: SEVERABILITY <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the ordinance is <br />for any reason held to be unconstitutional, invalid, or ineffective by any court of competent <br />jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions <br />of this Ordinance or any part hereof. The City Council hereby declares that it would have passed <br />each section, subsection, subdivision, paragraph, sentence, clause and phrase of the Ordinance <br />irrespective of the fact that one or more of them would be declared unconstitutional or invalid. <br />To this end, the provisions of the Ordinance are declared to be severable. <br /> <br />SECTION 4: EFFECTIVE DATE AND PUBLICATION. <br />This ordinance shall take effect thirty (30) days after adoption and the title thereof shall be <br />published once prior to adoption. <br /> <br />12 <br />
