<br />a. The first sentence of Section 4-23-300 is amended to read as follows: "An <br />application for an acupuncture or massage establishment permit shall be submitted to the City <br />Manager on forms provided by him." <br /> <br />b. Subsection (a) of Section 4-23-300 is hereby amended to read as follows: "The <br />exact nature of the acupuncture or massage to be administered, the proposed places of business <br />and facilities therefore, and the name and address of the applicant." <br /> <br />c. Subsection (g) of Section 4-23-300 is hereby amended to read as follows: "The <br />acupuncture, massage or similar business license history of the applicant; whether such person, <br />in previously operating in this or another city, county or state under license, has had such license <br />revoked or suspended, the reason therefore, and the business activity or occupation subsequent to <br />such action of suspension or revocation." <br /> <br />Section 10. Subsection (c) of Section 4-23-330 of Title 4 of the San Leandro <br />Municipal Code is hereby amended to read as follows: <br /> <br />"An acupuncturist, masseur or masseuse permit previously issued to any employee of, or <br />other person engaged in, the operation is revoked pursuant to the provisions of Article 4 of this <br />Chapter, for any act known to, and consented to by, any of the persons described in Section 4-23- <br />300, 4-23-305 or 4-23-310. Consent to such act shall be conclusively presumed if the person <br />having committed such act is permitted to continue to be employed or engaged in the operation <br />subsequent to the time that knowledge of the occurrence of such act is acquired by any of the <br />persons described in Sections 4-23-300, 4-23-305 or 4-23-335." <br /> <br />Section 11. Article 4 of Chapter 4-23 of Title 4 of the San Leandro Municipal Code, is <br />hereby renamed as follows: <br /> <br />"ARTICLE 4. PROCEDURE - ACUPUNCTURIST, MASSEUR OR MASSEUSE <br />PERMIT" <br /> <br />Section 12. Section 4-23-400 of Title 4 of the San Leandro Municipal Code is hereby <br />amended to read as follows: <br /> <br />"4-23-400 <br />PERMIT. <br /> <br />APPLICATION - ACUPUNCTURIST, MASSEUR OR MASSEUSE <br /> <br />An application for an acupuncture, masseur or masseuse permit shall be submitted to the <br />City Manager on forms provided by him. Such forms shall require submission of the following <br />information: <br /> <br />(a) The name and residence address of the applicant; <br /> <br />(b) For a masseur or masseuse permit, the name and address of the recognized school <br />attended, the dates attended and a copy of the diploma or certificate of graduation awarded the <br /> <br />949970-2 <br />ORDINANCE NO. 2007-008 <br /> <br />4 <br />
