<br />Section 18. Section 4-23-520 of the Title 4 of the San Leandro Municipal Code is <br />hereby amended to read as follows: <br /> <br />"No acupuncture or massage establishment granted a permit under the provisions of this <br />Article shall place, publish or distribute or cause to be placed, published or distributed any <br />advertising matter that depicts any portion of the human body that would reasonably suggest to <br />prospective patrons that any service is available other than those services described in Section 4- <br />23-100, nor shall any acupuncture or massage establishment indicate in the text of such <br />advertising that any service is available other than those services described in Section 4-23-100." <br /> <br />Section 19. Section 4-23-525 of Title 4 of the San Leandro Municipal Code is hereby <br />amended to read as follows: <br /> <br />"No acupuncture or massage may be carried on within any cubicle, room, booth or any <br />area within an acupuncture or massage establishment, which is fitted with a door capable of <br />being locked." <br /> <br />Section 20. Section 4-23-530 of Title 4 of the San Leandro Municipal Code is hereby <br />amended as follows: <br /> <br />a. The title of Section 4-23-530 is amended to read as follows: "4-23-530 <br />UNLICENSED ACUPUNCTURIST, MASSEUR OR MASSEUSE." <br /> <br />b. Section 4-23-530 is amended to read as follows: "No permittee shall employ as an <br />acupuncturist, masseur or masseuse any person who does not possess a valid unrevoked and <br />unexpired permit issued pursuant to the provisions of Article 4 of this Chapter." <br /> <br />Section 21. <br /> <br />Effective Date and Publication. <br /> <br />This ordinance shall take effect thirty (30) days after adoption and the title thereof shall <br />be published once prior to adoption. <br /> <br />Section 22. <br /> <br />Severability. <br /> <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the <br />ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of <br />competent jurisdiction, such decision shall not affect the validity or effectiveness of the <br />remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it <br />would have passed each section of the Ordinance irrespective of the fact that one or more of <br />them would be declared unconstitutional or invalid. To this end, the provisions of the Ordinance <br />are declared to be severable. <br /> <br />Introduced by Councilmember Stephens on this 16th day of April, 2007, and passed to <br />print by the following called vote: <br /> <br />949970-2 <br />ORDINANCE NO. 2007-008 <br /> <br />6 <br />
