<br />IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2005-013 RDA <br /> <br />(2888) <br /> <br />RESOLUTION APPROVING THE REUSE REPORT REQUIRED BY HEALTH AND <br />SAFETY CODE SECTION 33433 AND THE DISPOSITION AND DEVELOPMENT <br />AGREEMENT BETWEEN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN <br />LEANDRO AND 11 03 DAVIS STREET LLC FOR THE DISPOSITION AND <br />DEVELOPMENT OF THE PROPERTY LOCATED AT 1103 DAVIS STREET <br />(APN: 075-0120-061-04) <br /> <br />RECITALS <br /> <br />WHEREAS, the Agency has negotiated a Disposition and Development Agreement <br />("Agreement") between the Agency and 1103 Davis Street LLC ("Developer") to develop a nine- <br />unit residential subdivision at 1103 Davis Street, which will further the purposes of the Plaza <br />Redevelopment Plan; and <br /> <br />WHEREAS, the Agreement provides for the Agency to convey the parcel at 1103 Davis <br />Street (the "Property") to Developer for consideration in the amount of $520,000; and <br /> <br />WHEREAS, the Agency has caused to be prepared a report required by the Health and <br />Safety Code 933433 ("Reuse Report") which contains a summary of the proposed Agreement to <br />be entered into between the Agency and Developer and a summary of the cost of the Agreement <br />to the Agency; and <br /> <br />WHEREAS, the summary of the cost of the Agreement includes: land acquisition costs, <br />clearance costs, remediation costs, administrative costs, the estimated value of the interest to be <br />conveyed determined at the highest and best uses permitted under the proj ect plan, the estimated <br />value of the interest to be conveyed determined at use with conditions, covenants, and <br />development costs required by the sale; and an explanation of why the sale of the property will <br />assist in the elimination of blight; and <br /> <br />WHEREAS, the Agency has made the Reuse Report available for public inspection <br />pursuant to Health and Safety Code 933433; and <br /> <br />WHEREAS, the Agency has held a properly noticed public hearing and taken all other <br />actions required by law to prepare and present the Reuse Report; and <br /> <br />WHEREAS, the Agency does hereby take official notice of all documents, surveys, <br />records and reports maintained in the ordinary course of business by the Agency and the City of <br />San Leandro relating to the real properties which are the subject of the Reuse Report, and the <br />Agency has considered the report and recommendations regarding the Reuse Report, and has <br />provided an opportunity for all persons to be heard, and has received and considered all evidence <br />and testimony presented for or against any and all aspects of the Reuse Report; and <br />
