<br />V. Replacement Housing Payment For Tenants and Certain Others <br /> <br />If you qualify as an eligible displaced occupant you may be eligible for a Replacement Housing Payment in the form <br />of a Rent Differential. You may be eligible for a Replacement Housing Payment up to $5,250 to assist you in <br />buying or renting decent, safe, and sanitary housing. This payment is based on any increased rent you might have to <br />pay to obtain a similar dwelling. <br /> <br />To be eligible for this Replacement Housing Payment: <br /> <br />1. You must have legally occupied a room at the Islander Motel Lodge as a weekly tenant on May 23,2005; <br /> <br />2. You must have received a General Information Notice in May of 2005; <br /> <br />3. You must rent/purchase and occupy a decent, safe, and sanitary replacement dwelling within one (1) year <br />from the date of vacation from the replacement property. <br /> <br />4. You are residing in a decent, safe, and sanitary private dwelling when the payment is made. <br /> <br />5. Your claim for payment is submitted within eighteen (18) months of the date you move. <br /> <br />If you decide to purchase a home when you move, the Replacement Housing Payment can be used as a down <br />payment on your new dwelling. <br /> <br />Note: See Last Resort Housing <br /> <br />VI. Last Resort Housing <br /> <br />In some instances, the basic relocation program does not provide sufficient benefits to adequately rehouse a <br />household. The Agency may adopt a program to assist those households so as to provide comparable housing. The <br />extent to which the program would apply is undetermined; however, the family gross income and assets would be <br />one criteria for eligibility. You will be informed if this process applies to you. <br /> <br />VII. Appeals and Other Rights <br /> <br />Any person who has been refused a relocation payment or who disagrees with the amount of their relocation <br />payment has the right to appeal. Information about the appeal procedure is available from your Relocation Advisor. <br />Your Relocation Advisor will also help you to file an appeal. <br /> <br />You must file an appeal within eighteen (18) months of the time you vacate the dwelling. <br /> <br />In addition to your right to an appeal, Title VIII of the Civil Right Act of 1968 and later acts and <br />amendments make discriminatory practices in the purchase and rental of residential units illegal if it is <br />based on race, color, religion, sex, or national origin. Title VI of the Civil Rights Act of 1964 (42USC <br />2000d et. seq.) sets forth the policy of the United States, within constitutionallirnits to ensure that all <br />services and/or benefits will be administered without regard to race, color, national origin, or sex. <br /> <br />No relocation payment received will be considered as income for the purpose of the Internal Revenue <br />Code of 1954. <br /> <br />3 <br />
