<br />. <br /> <br />Section 2. Responsible Contracting. <br /> <br />Sections 1-5-225 and 1-6-220 of the San Leandro Municipal Code are each hereby <br />amended by adding the following language to each section: <br /> <br />For purposes of the foregoing, "reliability" includes a satisfactory record of compliance <br />with applicable statutes and regulations. As part of its bid, proposal, or other application <br />for a City contract, the bidder must submit a response, under penalty of perjury, to a City <br />questionnaire seeking to determine if the bidder has such record. During the term of its <br />contract with the City and as a provision of such contract, the contractor shall be required <br />to comply with all applicable state and federal laws and regulations, including health and <br />safety, environmental, labor and employment, and licensing laws, which may affect the <br />City, its residents, those working within the City, or the contractor's employees <br />performing services for the City or its residents. Each contractor shall notify the <br />Purchasing Agent within fifteen calendar days upon receiving notice that a court or <br />government agency has issued any finding of violation of such law, or formal complaint <br />that may result in a finding that the contractor has violated such law, even if such finding <br />or complaint is subject to further appeal. The foregoing shall not be applied to the extent, <br />if any, that a state or federal law precludes the City from considering such violations in <br />contracting decisions or from incorporating such laws into its contracts. <br /> <br />Section 3. <br /> <br />Severability. <br /> <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this <br />Ordinance is for any reason held to be unconstitutional, invalid or ineffective by any court of <br />competent jurisdiction, such decision shall not affect the validity or effectiveness of the <br />remaining portions of this Ordinance or any part hereof. The City Council hereby declares that it <br />would have passed each section, subsection, subdivision, paragraph, sentence, clause and phrase <br />of the Ordinance irrespective of the fact that one or more of them would be declared <br />unconstitutional or invalid. To this end, the provisions ofthis Ordinance are declared to be <br />severable. The courts are hereby authorized to reform the provisions of this Ordinance in order to <br />preserve the maximum permissible effect of each portion hereof. <br /> <br />Section 4. <br /> <br />Effective Date and Publication. <br /> <br />This ordinance shall take effect thirty (30) days after adoption.
