<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2007-075 <br /> <br />(1049/2999) <br /> <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN EASEMENT <br />AGREEMENT WITH SAFEW A Y, INC. FOR A 132.5 SQUARE FOOT PORTION <br />OF ITS PROPERTY AT 699 LEWELLING BOULEVARD TO MAINTAIN SIGNAL <br />FACILITIES REQUIRED FOR THE 1-8801W ASHINGTON AVENUE <br />INTERCHANGE PROJECT, PROJECT NO. 144-39-007 <br /> <br />Pursuant to Municipal Code Section 1-6-105, the City Manager is hereby authorized to <br />execute real property purchase agreements and all other related documents for the property <br />necessary for the 1-880/Washington Avenue Interchange project when terms and conditions of <br />such acquisitions are within the fair market appraisal obtained by the City or the compensation <br />paid is otherwise fair, just and equitable. <br /> <br />Such property acquisitions are considered categorically exempt under California <br />Environmental Quality Act (CEQA) Section 15332 and a Notice of Exemption will be filed. <br /> <br />Such property acquisitions are determined by the Planning Commission to be in <br />conformance with the City's General Plan under Government Code Section 65402. <br /> <br />NOW THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br /> <br />That the City Manager is authorized to execute an easement agreement with Safeway, <br />Inc. for the property located at 699 Lewelling Boulevard on behalf of the City of San Leandro. <br /> <br />Introduced by Councilmember Grant and passed and adopted this 4th day of June 2007, <br />by the following called vote: <br /> <br />Members of the Council: <br /> <br />AYES: Councilmembers Grant, Gregory, ProIa, Souza, Starosciak, Stephens; <br />Mayor Santos <br /> <br />(7) <br />(0) <br />(0) <br /> <br />NOES: None <br /> <br />ABSENT: None <br /> <br />ATTEST: <br /> <br />~~ <br /> <br />Marian Handa, City Clerk <br />
