<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2007- <br /> <br />RESOLUTION ADOPTING A MITIGATED NEGATNE DECLARATION FOR THE <br />BAY TRAIL SLOUGH BRIDGE PROJECT, PROJECT NO. 144-36-012, <br />AS COMPLETE AND IN COMPLIANCE WITH THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) <br /> <br />WHEREAS, construction of a new pedestrianlbicycle bridge and trail is necessary to <br /> <br />connect the Oyster Bay Regional Shoreline, owned by East Bay Regional Park District and <br /> <br />located within the City of San Leandro, with recently constructed Bay Trail facilities that are <br /> <br />located to the north on property owned by the Port of Oakland; and <br /> <br />WHEREAS, a grant from Transportation Equity Act: A Legacy for Users (TEA-LU) <br /> <br />Reauthorization ($528,000) is secured; and <br /> <br />WHEREAS, a grant from the Metropolitan Transportation Commission Regional Bicycle <br /> <br />and Pedestrian Program (RBPP) is pending; and <br /> <br />WHEREAS, a grant agreement with ACTIA will provide partial funding for the <br /> <br />construction of the project; and <br /> <br />WHEREAS, on February 4,2004 by Resolution No. 2004-021, the City Council <br /> <br />approved a grant agreement with the Association of Bay Area Governments (ABAG) to provide <br /> <br />design services for the subject project; and <br /> <br />WHEREAS, on July 19, 2004 by Resolution No. 2004-119, the City Council approved a <br /> <br />contractual services agreement with Mark Thomas & Company, Inc. to provide design services <br /> <br />for the subject project; and <br /> <br />WHEREAS, on July 19, 2004 by Resolution No. 2004-119, the City Council approved a <br /> <br />contractual services agreement with Mark Thomas & Company, Inc. to provide design services <br /> <br />for the subject project; and <br />
