<br />The Draft Initial Study/Mitigated Negative Declaration ("ISIMND") published for a 30-day <br />review period from 10 October to 14 November 2005 by the East Bay Regional Park District <br />("EBRPD"). <br /> <br />. During the public review period, the EBRPD received comments from three public agencies <br />regarding the adequacy of the environmental analysis contained in the Draft IS/MND. The <br />commenting agencies were: <br /> <br />. Letter 1: California Department ofFish and Game ("CDFG") <br />. Letter 2: Port of Oakland ("Port") <br />. Letter 3: San Francisco Bay Conservation and Development Commission ("BCDC") <br /> <br />The comment letters have been numbered, as indicated above, and are attached to this <br />Memorandum. Within each letter, each comment has been numbered (for example comment 1 in <br />Letter 1 is labeled as "1-1" in the margin of the letter). Below is a response to each comment <br />contained in the three comment letters. <br /> <br />Letter 1: CDFG. dated 10 November 2005 <br /> <br />Comment 1-1: An environmental filing fee is required to be submitted. at the time of filing a <br />Notice of Determination. <br /> <br />Response 1-1: Comment noted. <br /> <br />Comment 1-2: A complete assessment of the flora and fauna adjacent to the project area should <br />be provided. <br /> <br />Response 1-2: The Draft IS/MND, Section IV, provides a detailed assessment of the flora <br />and fauna of the project area, including the occurrence of special status species. The <br />IS/MND provides specific mitigation measures to avoid impacts to adjacent habitat for <br />special status species. <br /> <br />Comment 1-3: A Streambed Alteration Agreement may be required from the CDFG and the <br />IS/MND should fully identify potential impacts to stream or riparian resources and provide <br />adequate avoidance, mitigation, monitoring, and reporting commitments for the agreement. <br /> <br />Response 1-3: As part of the permitting process for the proposed project, the EBRPD and/or <br />the City of San Leandro will coordinate permitting requirements with CDFG. Section IV of <br />the IS/MND provides detailed discussions of impacts to stream and riparian resources and <br />identifies specific mitigation measures (Mitigation Measures IV-I, 2, and 3) for avoidance <br />of impacts. <br /> <br />Letter 2: Port of Oakland. dated 14 November 2005 <br /> <br />Comment 2-1: Alternative 2 for th~ trail connection appears to result in fewer environmental <br />impacts than Alternative 1 (the preferred alternative).
