Peterson, Administrativ Services Mana~ <br /> <br />BY: <br /> <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br /> <br />RESOLUTION APPROVING THE FIRST AMENDMENT TO THE LICENSE AGREEMENT <br />BETWEEN THE CITY OF SAN LEANDRO AND THE EAST BAY REGIONAL PARK <br />DISTRICT FOR A PORTION OF THE SHORELINE TRAIL <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />On April 19, 1982, the City of San Leandro and the East Bay Regional Park District (District) <br />entered into a license agreement to allow for the construction, reconstruction, maintenance, and <br />use ofthe right-of-way and access to a portion of the Shoreline Trail. <br /> <br />The District has requested an extension of this Agreement for another 25-year term. The first <br />amendment to the license agreement will allow for the extension. It is recommended that the <br />City Council adopt a resolution approving the First Amendment to License and authorizing the <br />City Manager to execute same. <br /> <br />BACKGROUND <br /> <br />The City owns a site along the bay known as Assessor's Parcel No. (APN) 80G-91O-2-11 that <br />lies between San Lorenzo Creek and Grant Avenue, which the District uses as the Shoreline <br />Trail. The original License Agreement of 1982 outlines the understanding of the parties, <br />including a provision that the term of the Agreement may be renewed by the parties upon mutual <br />acceptance. This First Amendment to License provides for an extension of the Agreement for <br />another 25-year period, from April 19, 2007 to April 19, 2032. <br /> <br />Analvsis <br /> <br />At the District's request, the First Amendment to the License was written to extend the license <br />term another 25 years. The Amendment includes updated insurance requirements and additional <br />allowances for revocation of the license in case of damage to the trail or a change of use by the <br />City that is incompatible with the District's use. <br />
