<br />AN ORDINANCE ADOPTING A PROGRAM FOR THE USE OF EMINENT
<br />DOMAIN BY THE CITY OF SAN LEANDRO REDEVELOPMENT AGENCY
<br />FOR THE PLAZA REDEVELOPMENT PROJECT AREA PURSUANT TO SB 53
<br />
<br />WHEREAS, the Redevelopment Agency of the City of San Leandro, a public body
<br />corporate and politic (the "Agency") is a redevelopment agency duly organized pursuant to
<br />Community Redevelopment Law (California Health and Safety Code Section 33000 et seq.), and
<br />pursuant thereto has responsibility to carry out the Redevelopment Plan for the Plaza
<br />Redevelopment Project Area (the "Project Area"); and
<br />
<br />WHEREAS, the redevelopment plan for the Plaza 1 redevelopment project area
<br />("Plaza 1 Project Area") was adopted by the City Council of the City of San Leandro (the "City
<br />Council") by Ordinance No. 1295 N.S. on December 28, 1960, and was thereafter amended by
<br />Ordinance No. 67-63, adopted on December 26, 1967, Ordinance No. 71-29, adopted on October
<br />26, 1971, Ordinance No. 75-39, adopted on August 4, 1975, Ordinance No. 80-34, adopted on
<br />July 14, 1980, Ordinance 82-094, adopted on November 29, 1982, Ordinance 86-038, adopted on
<br />December 15,1986, Ordinance 94-018, adopted on September 6,1994, and Ordinance No. 95-
<br />042 adopted on December 18, 1995, and;
<br />
<br />WHEREAS, the redevelopment plan for the Plaza 2 redevelopment project area
<br />("Plaza 2 Project Area") was adopted by the City Council by Ordinance No. 67-62 on
<br />December 26, 1967, and was thereafter amended by Ordinance No. 71-28, adopted on
<br />October 26, 1971, Ordinance No. 74-14, adopted on February 25, 1974, Ordinance No. 79-39,
<br />adopted on December 17, 1979, Ordinance No. 81-019, adopted on March 30, 1981, Ordinance
<br />No. 82-093, adopted on November 29, 1982, Ordinance No. 83-026, adopted on October 10,
<br />1983, Ordinance No. 85-049, adopted on January 6, 1986, Ordinance No. 86-039, adopted on
<br />December 15, 1986, Ordinance No. 88-013, adopted on July 5, 1988, Ordinance No. 94-019,
<br />adopted on September 6, 1994, Ordinance No. 94-029, adopted on December 19, 1994,
<br />Ordinance No. 95-05, adopted on March 20, 1995, Ordinance No. 95-06, adopted on March 20,
<br />1995, and by Ordinance No. 97-025, adopted on September 2, 1997;
<br />
<br />WHEREAS, the redevelopment plans for Plaza 1 and Plaza 2 redevelopment project
<br />areas were merged to create the Plaza redevelopment project area (Plaza Project Area) by
<br />Ordinances 2000-09 and 2000-010, adopted on June 5, 2000, and was further amended by
<br />Ordinance No. 2000-010, adopted on June 5, 2000, Ordinance No. 2001-021, adopted on
<br />November 5, 2001, Ordinance No. 2003-019, adopted on December 15, 2003 and by Ordinance
<br />No. 2005-009, adopted on July 18, 2005 (the redevelopment plans as so amended, hereafter, the
<br />"Redevelopment Plan"); and
<br />
<br />WHEREAS, effective January 1, 2007, SB 53 added Section 33342.7 to the Health and
<br />Safety Code, pursuant to which legislative bodies that adopted a final redevelopment plan prior
