<br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />ORDINANCE NO. 2007-015 <br /> <br />(311 0/3118) <br /> <br />AN ORDINANCE ADOPTING A PROGRAM FOR THE USE OF EMINENT <br />DOMAIN BY THE CITY OF SAN LEANDRO REDEVELOPMENT AGENCY <br />FOR THE WEST SAN LEANDRO/MACARTHUR BOULEVARD <br />REDEVELOPMENT PROJECT AREA PURSUANT TO SB 53 <br /> <br />WHEREAS, the Redevelopment Agency of the City of San Leandro, a public body <br />corporate and politic (the "Agency") is a redevelopment agency duly organized pursuant to <br />Community Redevelopment Law (California Health and Safety Code Section 33000 et seq.), and <br />pursuant thereto has responsibility to carry out the Redevelopment Plan for the West <br />San LeandrolMacArthur Boulevard Redevelopment Project Area (the "Project Area"); and <br /> <br />WHEREAS, the redevelopment plan for the Project Area was adopted by the City <br />Council of the City of San Leandro (the "City Council") by Ordinance No. 99-025 on July 9, <br />1999, and was thereafter amended by Ordinance No. 2000-14, adopted on June 26,2000 and by <br />Ordinance No. 2003-030, adopted on December 15, 2003 (as so amended, hereafter, the <br />"Redevelopment Plan"); and <br /> <br />WHEREAS, effective January 1, 2007, SB 53 added Section 33342.7 to the Health and <br />Safety Code, pursuant to which legislative bodies that adopted a final redevelopment plan prior <br />to January 1, 2007 are required to adopt on or before July 1, 2007, an ordinance that describes <br />the redevelopment agency's program to acquire real property by eminent domain; and <br /> <br />WHEREAS, SB 53 provides that following adoption of an ordinance describing the <br />redevelopment agency's program to acquire real property by eminent domain, such program may <br />only be modified pursuant to an amendment ofthe redevelopment plan; and <br /> <br />WHEREAS, the Redevelopment Plan provides the Agency with authority to use eminent <br />domain to acquire real property in certain limited circumstances following compliance with all <br />requirements of law. <br /> <br />The City Council of the City of San Leandro does ORDAIN as follows: <br /> <br />Section 1. <br /> <br />Adoption of Program. <br /> <br />The following is hereby adopted as the Agency's program to acquire real property by <br />eminent domain pursuant to Health and Safety Code Section 33342.7: <br /> <br />The Redevelopment Plan for the West San LeandrolMacArthur Boulevard <br />Redevelopment Project Area authorizes the Agency to acquire real property by eminent domain <br />throughout the Project Area. The Redevelopment Agency may only acquire property by eminent <br />domain following compliance with all requirements of applicable law, including without <br />
